Pursuant to section 363(d) of the Property Law Act 2007, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.


1  Title
  • These regulations are the Property Law (Mortgagees' Sales Forms and Fees) Amendment Regulations 2011.

2  Commencement
  • These regulations come into force on 1 July 2011.

3  Principal regulations amended
4  Application fee
  • Regulation 7 is amended by omitting $1,200 and substituting $1,306.90.

5  Commission fees
  • Regulation 8 is amended by—

    • (a) omitting $300 and substituting $326.70; and

    • (b) omitting $14,000 and substituting $15,247.10.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 July 2011, are made under the Property Law Act 2007 (the Act). They amend mortgagees' sales forms and fees regulations made under the Act. An application fee and minimum and maximum commission fees for sales by a vendor mortgagee through a Registrar are adjusted to reflect the movement in the New Zealand Consumers Price Index (All Groups) since those regulations came into force on 1 January 2008.

The fees replaced are inclusive of goods and services tax (GST), but were not amended directly to reflect the 1 October 2010 GST increase, and so differed from those actually charged. The new fees are also GST inclusive.
