This notice is administered by the Ministry of Health.

Pursuant to section 54 of the Health Practitioners Competence Assurance Act 2003, the Minister of Health, being satisfied of the matters set out in section 54(3) of that Act, gives the following notice.

Notice

1 Title

This notice is the Health Practitioners (Quality Assurance Activity—Bowen Hospital) Notice 2011.

2 Commencement

This notice comes into force on the day after the date of its notification in the Gazette.

3 Declaration of protected quality assurance activity

The Bowen Hospital Quality Assurance Activity described in the Schedule is a protected quality assurance activity.

Schedule Description of Bowen Hospital Quality Assurance Activity

1 Interpretation

In this schedule,—

activity means the Bowen Hospital Quality Assurance Activity described in clause 4

participant means a health practitioner who—

(a)

provides health services at Bowen Hospital; and

(b)

is either—

(i)

employed by Wakefield Health Limited; or

(ii)

authorised by Wakefield Health Limited to provide those health services; and

(c)

is participating in the activity.

2 Objective

The objective of the activity is to improve the practices and competence of health practitioners engaged in the activity by assessing the health services performed by those health practitioners.

3 Information

The activity is based on information derived from participants.

4 Activity

(1)

The activity is undertaken at Bowen Hospital by—

(a)

health practitioners providing health services at Bowen Hospital; and

(b)

the Bowen Hospital Medical Advisory Group; and

(c)

the Bowen Hospital Clinical Advisory Committee.

(2)

The activity involves—

(a)

the participants holding peer-review meetings to discuss clinical practices, and reporting any adverse practices to the Bowen Hospital Clinical Advisory Committee; and

(b)

the Bowen Hospital Medical Advisory Group—

(i)

analysing the following data on patients:

(A)

morbidity; and

(B)

mortality; and

(C)

unplanned returns to theatre; and

(D)

unplanned transfers to another health facility; and

(E)

readmissions; and

(F)

infection rates; and

(G)

treatment outcome variances; and

(ii)

reviewing—

(A)

patient records; and

(B)

processes and practices; and

(C)

patient management and treatment decisions; and

(D)

trends in patient care; and

(iii)

reporting to the Bowen Hospital Clinical Advisory Committee any adverse findings identified as a result of the analyses and reviews undertaken under subparagraphs (i) and (ii); and

(c)

the Bowen Hospital Clinical Advisory Committee—

(i)

reviewing and analysing any reports received under paragraph (a) or (b)(iii); and

(ii)

making recommendations to individual participants on how the participant may improve his or her performance so as to—

(A)

improve the quality of care he or she provides; and

(B)

reduce the incidence of adverse outcomes; and

(iii)

facilitating and monitoring the implementation of any such recommendations.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on the day after the date of its notification in the Gazette, declares the quality assurance activity called the Bowen Hospital Quality Assurance Activity to be a protected quality assurance activity. The effect of this declaration is that—

  • any information that becomes known solely as a result of the activity is confidential; and

  • any documents brought into existence solely for the purposes of the activity are confidential; and

  • the people who engage in the activity in good faith are immune from civil liability.

The protections afforded by this notice are subject to certain statutory exceptions. For example, this notice does not prohibit the disclosure of information that does not identify, either expressly or by implication, a particular individual.

This notice remains in force for a period of 5 years after the date on which it is issued, unless it is sooner revoked.
