Pursuant to section 297 of the Fisheries Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 October 2011, amend the Fisheries (Auckland and Kermadec Areas Commercial Fishing) Regulations 1986.

On 15 September 2011, the Tāwharanui Marine Reserve was created under the Marine Reserves Act 1971. Regulation 23(1)(a) of the principal regulations prohibits the taking of fish and seaweed by commercial fishers in an area that largely overlaps with the new marine reserve. These regulations revoke regulation 23(1)(a) as the prohibition is no longer needed in fisheries legislation as it is an offence to take or remove marine life from a marine reserve under the Marine Reserves Act 1971.
