Pursuant to section 67B of the Fisheries Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, and on the recommendation of the Minister of Fisheries and Aquaculture after complying with the requirements of section 67B(3) of that Act, makes the following order.


1  Title
  • This order is the Fisheries (Schedule 5A) Order 2011.

2  Commencement
  • This order comes into force on 1 October 2011.

3  Stocks omitted from Schedule 5A of Fisheries Act 1996
  • Schedule 5A of the Fisheries Act 1996 is amended by omitting the following items:

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 1 October 2011, amends Schedule 5A of the Fisheries Act 1996 (the Act), which lists stock for which no additional annual catch entitlement may be allocated where underfishing occurs. The amendments omit all paua stocks from Schedule 5A. This has the effect of allowing a person who holds an annual catch entitlement (ACE) for paua to carry over up to 10% of the person's uncaught ACE in the first fishing year into the second fishing year, as provided for in section 67A(2) of the Act.
