Civil Aviation (Offences) Amendment Regulations 2011

Pursuant to section 100 of the Civil Aviation Act 1990, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

  • These regulations are the Civil Aviation (Offences) Amendment Regulations 2011.

Items relating to Part 125 (Air operations—medium aeroplanes) of the Civil Aviation Rules

Insert after item relating to rule 125.57(d):

Rule 125.58  Holder of air operator certificate must ensure search and rescue information is carried on-board aeroplane. 2,50015,0001,0006,000

Items relating to rule 125.63(a) to (c): omit and substitute:

Rule 125.63(a) Holder of air operator certificate must establish prescribed flight check system for each aeroplane. 2,50015,0001,0006,000
Rule 125.63(d) Flight crew member performing air operation must use cockpit checklist in accordance with flight check system. 2,500 1,000 

Item relating to rule 125.87: omit and substitute:

Rule 125.87 Holder of air operator certificate must ensure aeroplane is not operated on extended over-water operation unless prescribed requirements are met. 5,00030,0002,00012,000
Rule 125.89 Pilot-in-command must perform air operation at night under IFR except as prescribed. 5,000 2,000 

Items relating to rule 125.155(a) to (d): omit and substitute:

Rule 125.155(a) Pilot-in-command must not commence flight under VFR unless current meteorological reports indicate prescribed VFR minima can be complied with. 5,000 2,000 
Rule 125.155(b) Pilot-in-command performing air operation under VFR outside controlled airspace must comply with prescribed requirements. 5,000 2,000 
Rule 125.155(c) Pilot-in-command must not perform air operation under VFR above more than scattered cloud unless prescribed requirements are met. 5,000 2,000 

Item relating to rule 125.157: omit and substitute:

Rule 125.157(a) Pilot-in-command must not commence air operation under IFR unless current meteorological reports indicate the matters prescribed. 5,000 2,000 
Rule 125.157(b) Pilot-in-command must not commence air operation under IFR unless flight plan complies with prescribed alternate aerodrome requirements. 2,500 1,000

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 21 October 2011, amend the Civil Aviation (Offences) Regulations 2006.

The amendments specify new offences and penalties in relation to Part 125 of the Civil Aviation Rules.
