Pursuant to sections 7, 8, and 9 of the Major Events Management Act 2007, Her Excellency the Administrator of the Government makes the following order, acting—

  • (a) on the advice and with the consent of the Executive Council; and

  • (b) on the recommendations of the Minister for Economic Development made after the consultation required by, and compliance with every other requirement for the making of those recommendations that is specified in, sections 7 and 8 of that Act.

Order

1  Title
  • This order is the Major Events Management (Triathlon World Cup 2011 Series Event and Triathlon World Championship Grand Final 2012) Order 2011.

2  Commencement
  • This order comes into force on 18 November 2011.

3  Interpretation
  • In this order, unless the context otherwise requires,—

    ITU means the International Triathlon Union

    Triathlon World Championship Grand Final 2012 means the ITU Triathlon World Championship Grand Final 2012 to be held at Auckland on and after 14, but before the close of 23, October 2012

    Triathlon World Champs 2012 Limited means Triathlon World Champs 2012 Limited, a company incorporated in New Zealand under Part 2 of the Companies Act 1993

    Triathlon World Cup 2011 Series Event means the event—

    • (a) scheduled to be the ninth event in the series of ITU Triathlon World Cup 2011 events; and

    • (b) to be held at Auckland on 20 November 2011.

4  Triathlon World Cup 2011 Series Event declared to be major event
  • The Triathlon World Cup 2011 Series Event is declared by this clause to be a major event.

5  Triathlon World Championship Grand Final 2012 declared to be major event
  • The Triathlon World Championship Grand Final 2012 is declared by this clause to be a major event.

6  Triathlon World Champs 2012 Limited is major event organiser
  • Triathlon World Champs 2012 Limited is the major event organiser of both—

    • (a) the Triathlon World Cup 2011 Series Event; and

    • (b) the Triathlon World Championship Grand Final 2012.

Declarations of protection periods, major event emblems, and major event words

7  Declarations of protection periods
  • (1) The protection period for the Triathlon World Cup 2011 Series Event is declared by this subclause to start on 18 November 2011 and end on the close of 19 December 2011.

    (2) The protection period for the Triathlon World Championship Grand Final 2012 is declared by this subclause to start on 1 January 2012 and end on the close of 19 November 2012.

8  Declarations of major event emblems
  • (1) The emblem set out in Part 1 of Schedule 1 is declared by this subclause to be a major event emblem for the protection period of the Triathlon World Cup 2011 Series Event.

    (2) The emblem set out in Part 1 of Schedule 2 is declared by this subclause to be a major event emblem for the protection period of the Triathlon World Championship Grand Final 2012.

9  Declarations of major event words
  • (1) The combinations of words set out in Part 2 of Schedule 1 are declared by this subclause to be major event words for the protection period of the Triathlon World Cup 2011 Series Event.

    (2) The combinations of words set out in Part 2 of Schedule 2 are declared by this subclause to be major event words for the protection period of the Triathlon World Championship Grand Final 2012.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 18 November 2011, is made under the Major Events Management Act 2007 (the Act). It relates to 2 International Triathlon Union (ITU) events, namely,—

  • the ITU Triathlon World Cup 2011 Series Event to be held at Auckland on 20 November 2011; and

  • the ITU Triathlon World Championship Grand Final 2012 to be held at Auckland on and after 14, but before the close of 23, October 2012.

The order—

  • declares the events to be major events:

  • identifies the major event organiser for the events:

  • declares the protection periods for the events:

  • declares emblems and words to be, for those periods, major event emblems and major event words.

The Act contains, in subpart 2 of Part 2, protections against ambush marketing by association. Those protections restrict, during the protection period of a major event, a person's ability to make a representation (such as in an advertisement) suggesting that there is an association between the major event and goods or services, a brand of goods or services, or a person who provides goods or services. There is a presumption that a representation that includes a major event emblem or major event words suggests such an association.
