This notice is administered by the Ministry of Health.

Pursuant to section 54 of the Health Practitioners Competence Assurance Act 2003, the Minister of Health, being satisfied of the matters set out in section 54(3) of that Act, gives the following notice.

Notice

1 Title

This notice is the Health Practitioners (Quality Assurance Activity—Ormiston Hospital) Notice 2011.

2 Commencement

This notice comes into force on the day after the date of its notification in the Gazette.

3 Declaration of protected quality assurance activity

The Ormiston Hospital Quality Assurance Activity described in the Schedule is a protected quality assurance activity.

Schedule Description of Ormiston Hospital Quality Assurance Activity

1 Interpretation

In this schedule,—

activity means the Ormiston Hospital Quality Assurance Activity described in clause 4

Clinical Director means the person appointed as the Clinical Director of Ormiston Hospital

participating health practitioners means health practitioners who—

(a)

provide health services at Ormiston Hospital; and

(b)

are either—

(i)

employed by Ormiston Hospital; or

(ii)

authorised by Ormiston Hospital to provide those health services; and

(c)

are participating in the activity

review meetings means morbidity and mortality review meetings that are attended by—

(a)

the Clinical Director:

(b)

the members of the Senior Management Team of Ormiston Hospital:

(c)

participating health practitioners:

(d)

any other persons requested to attend by the Clinical Director.

2 Objective

The objective of the activity is to improve—

(a)

the practices and competence of participating health practitioners by assessing the health services performed by those practitioners; and

(b)

outcomes for patients by ensuring that they receive the highest possible standard of surgical care and management.

3 Information

The activity is based on information derived from—

(a)

the Clinical Director; and

(b)

participating health practitioners.

4 Activity

The activity involves—

(a)

the Clinical Director identifying those surgical care cases at Ormiston Hospital in which there have been adverse outcomes, complications, or problems arising from patient care or management; and

(b)

the participating health practitioners with knowledge of the cases referred to in paragraph (a) presenting information about those cases at review meetings; and

(c)

the Clinical Director and the other attendees at review meetings—

(i)

discussing the information presented under paragraph (b); and

(ii)

recommending how participating health practitioners can improve their performance so as to—

(A)

improve the quality of care they provide; and

(B)

reduce the incidence of adverse outcomes, complications, or problems; and

(d)

the Clinical Director reporting any recommendations made under paragraph (c)(ii) to—

(i)

the Clinical Advisory Committee of Ormiston Hospital; and

(ii)

all participating health practitioners; and

(iii)

any other health practitioner or group or groups of health practitioners that the Clinical Director considers appropriate; and

(e)

the Clinical Director monitoring the implementation of any such recommendations at Ormiston Hospital.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on the day after the date of its notification in the Gazette, declares the quality assurance activity called the Ormiston Hospital Quality Assurance Activity to be a protected quality assurance activity. The effect of this declaration is that—

  • any information that becomes known solely as a result of the activity is confidential; and

  • any documents brought into existence solely for the purposes of the activity are confidential; and

  • the people who engage in the activity in good faith are immune from civil liability.

The protections afforded by this notice are subject to certain statutory exceptions. For example, this notice does not prohibit the disclosure of information that does not identify, either expressly or by implication, a particular individual.

Under section 54(4) of the Health Practitioners Competence Assurance Act 2003, this notice remains in force for a period of 5 years after the date on which it is issued, unless it is sooner revoked.
