Health Practitioners (Quality Assurance Activity—Gillies Hospital) Notice 2012

Pursuant to section 54 of the Health Practitioners Competence Assurance Act 2003, the Minister of Health, being satisfied of the matters set out in section 54(3) of that Act, gives the following notice.

Notice

1  Title
  • This notice is the Health Practitioners (Quality Assurance Activity—Gillies Hospital) Notice 2012.

2  Commencement
  • This notice comes into force on the day after the date of its notification in the Gazette.

3  Declaration of protected quality assurance activity
  • The Gillies Hospital Quality Assurance Activity described in the Schedule is a protected quality assurance activity.

Description of Gillies Hospital Quality Assurance Activity

1  Interpretation
  • In this schedule,—

    activity means the Gillies Hospital Quality Assurance Activity described in clause 4

    participant means a health practitioner who—

    • (a) provides health services at Gillies Hospital; and

    • (b) is either—

      • (i) employed by Gillies Hospital; or

      • (ii) authorised by Gillies Hospital to provide those health services; and

    • (c) is participating in the activity.

2  Objective
  • The objective of the activity is to improve the practices and competence of health practitioners engaged in the activity by assessing the health services performed by those health practitioners.

3  Information
  • The activity is based on information that—

    • (a) is derived from participants; and

    • (b) relates to health services provided at Gillies Hospital.

4  Activity
  • The activity involves—

    • (a) examining patients' records; and

    • (b) analysing the following data on patients:

      • (i) admission and discharge; and

      • (ii) morbidity and mortality; and

      • (iii) outcomes of treatment; and

    • (c) analysing the patient care process; and

    • (d) identifying and analysing any process or practice that results in an outcome for patients that may, but need not, be an adverse outcome; and

    • (e) preparing adverse outcome reports; and

    • (f) preparing documentation that summarises adverse outcome reports and identifies trends showing up in them; and

    • (g) presenting and discussing the results obtained under paragraphs (a) to (f); and

    • (h) developing strategies to respond to trends; and

    • (i) undertaking multi-disciplinary case reviews and peer reviews; and

    • (j) making recommendations on how participants can improve their performance so as to—

      • (i) improve the quality of care they provide; and

      • (ii) reduce the incidence of adverse outcomes; and

    • (k) facilitating and monitoring the implementation of any such recommendations.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on the day after the date of its notification in the Gazette, declares the quality assurance activity called the Gillies Hospital Quality Assurance Activity to be a protected quality assurance activity. The effect of this declaration is that—

  • any information that becomes known solely as a result of the activity is confidential; and

  • any documents brought into existence solely for the purposes of the activity are confidential; and

  • the people who engage in the activity in good faith are immune from civil liability.

The protections afforded by this notice are subject to certain statutory exceptions. For example, this notice does not prohibit the disclosure of information that does not identify, either expressly or by implication, a particular individual.

This notice remains in force for a period of 5 years after the date on which it is issued, unless it is sooner revoked.

This notice revokes the Health Practitioners (Quality Assurance Activity—Gillies Hospital) Notice 2006, which has expired.
