Commerce Act (Fees) Amendment Regulations 2012

Pursuant to section 108 of the Commerce Act 1986, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

Regulations

1 Title
  • These regulations are the Commerce Act (Fees) Amendment Regulations 2012.

2 Commencement
  • These regulations come into force on the 28th day after the date of their notification in the Gazette.

3 Principal regulations
4 Regulation 2 amended (Fees prescribed for purposes of Commerce Act 1986)
  • Before regulation 2(a), insert:

    • (aa) for a proposal for a customised price-quality path under section 53Q of the Act, a standard application fee of $23,000:.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on the 28th day after the date of their notification in the Gazette, prescribe a fee of $23,000 (inclusive of goods and services tax) for a proposal for a customised price-quality path under Part 4 of the Commerce Act 1986 (which relates to regulated goods and services).

This fee is the up-front payment. Section 53Y of the Commerce Act 1986 provides that the Commerce Commission's costs in assessing a proposal for, and setting or reconsidering, a customised price-quality path must be met by the person who makes the proposal for a customised price-quality path. If the amount paid by a person in respect of a proposal for a customised price-quality path exceeds the Commission's costs in assessing the proposal and (if applicable) setting or reconsidering the customised price-quality path, the Commission may refund the excess to the person who paid it.
