Hauraki Māori Trust Board Order 2012

Pursuant to section 55 of the Maori Trust Boards Act 1955, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

Order

1 Title
  • This order is the Hauraki Māori Trust Board Order 2012.

2 Commencement
  • This order comes into force on 31 August 2012.

3 Interpretation
4 Background
  • (1) For the purposes of electing members, the Board has 12 sections representing 12 iwi.

    (2) The process for electing new members to the Board began on 4 November 2011 and resulted in the election of 11 members.

    (3) No member was elected in relation to the Ngāti Paoa section because the only nomination received was received 2 days after the closing date for nominations (18 January 2012) and was not accepted by the Board.

    (4) As a result, the Board has 11 members instead of 12 and no member has been elected by the Ngāti Paoa section.

    (5) The Maori Trust Boards Act 1955 does not make provision for a further election for a section in the circumstances described in this clause.

5 Further election for Ngāti Paoa member of the Board to be held
  • A further election of a person as a member of the Board to represent the Ngāti Paoa section of the beneficiaries of the Board must be held in accordance with the following provisions:

    • (a) not later than 14 September 2012, the secretary of the Board must cause public notice to be given to every beneficiary of the Board who is enrolled in the Ngāti Paoa section of beneficiaries of the fact that nominations are called for election to membership of the Board for the ensuing term, the method of lodging nominations, and the latest date, as fixed by paragraph (b), by which nominations must be lodged with the secretary of the Board:

    • (b) nominations must be lodged with the secretary of the Board not later than 12 October 2012:

    • (c) if an election is required, the secretary of the Board must, not later than 12 November 2012, post to each beneficiary of the Board who is enrolled in the Ngāti Paoa section of beneficiaries and shown on the roll of beneficiaries as entitled to vote at the election a printed ballot paper setting out the full names of each candidate for election, the method of marking the ballot paper to indicate the beneficiary's preference, the address to which the ballot paper is to be returned, and the latest time, as fixed by paragraph (d), for its return:

    • (d) ballot papers must, not later than 14 December 2012, be posted to or lodged with the returning officer appointed by the Minister for the purpose of the election:

    • (e) the secretary of the Board must, not later than 21 December 2012, forward to the chief executive of Te Puni Kōkiri the name of the person elected as a member of the Board for the Ngāti Paoa section of beneficiaries:

    • (f) the person elected as a member of the Board for the Ngāti Paoa section of beneficiaries is to hold office until the close of 13 May 2015:

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 31 August 2012, provides for a further election to be held for a member of the Hauraki Māori Trust Board to represent the Ngāti Paoa section of the beneficiaries of that Board.
