Pursuant to section 42 of the Food Act 1981, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.


1 Title
  • These regulations are the Food (Safety) Amendment Regulations 2012.

2 Commencement
  • These regulations come into force on the 28th day after the date of their notification in the Gazette.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force 28 days after the date they are notified in the Gazette, amend regulation 4 of the Food (Safety) Regulations 2002. Regulation 4 provides that regulations 24 and 26 are to expire on 30 October 2012. This expiry date is shifted to 30 October 2017.

Regulation 24 provides that water added to food must be of potable quality and may contain fluoride. Regulation 26 provides that oil extracted from hemp seed may be sold as food under specified conditions. The amendment to regulation 4 means that regulations 24 and 26 will continue to apply until 30 October 2017.
