Fisheries (Total Allowable Commercial Catch) Amendment Notice 2012: revoked, on 29 September 2015, pursuant to clause 9(1) of the Fisheries (Total Allowable Catch, Total Allowable Commercial Catch, and Deemed Value Rates) Notice 2015 (LI 2015/211).

This notice is administered by the Ministry for Primary Industries.

Pursuant to section 20 of the Fisheries Act 1996, the Minister for Primary Industries, after satisfying the requirements of section 21 of that Act, gives the following notice.

Notice

1 Title

This notice is the Fisheries (Total Allowable Commercial Catch) Amendment Notice 2012.

2 Commencement

This notice comes into force on 30 September 2012.

3 Application

This notice applies on and from 1 October 2012.

4 Principal notice

This notice amends the Fisheries (Total Allowable Commercial Catch) Notice 2009 (the principal notice).

5 Schedule replaced

Replace the Schedule with the Schedule set out in the Schedule of this notice.

6 Consequential amendments to Fisheries (Quota Management Areas, Total Allowable Catches, and Catch Histories) Notice 1986

This clause amends Schedule 1 of the Fisheries (Quota Management Areas, Total Allowable Catches, and Catch Histories) Notice 1986.

In item B of the item relating to ghost shark, delete “66”.

In item H of the item relating to ghost shark, delete “22”.

7 Consequential amendment to Fisheries (Total Allowable Commercial Catch) Notice 2004

This clause amends the Schedule of the Fisheries (Total Allowable Commercial Catch) Notice 2004 (Gazette 2004, p 2435).

In the item relating to porae, delete the item relating to fishstock codes POR2, POR8, and POR9.

8 Consequential amendments to Fisheries (Total Allowable Commercial Catch) Notice (No 2) 2004

This clause amends the Schedule of the Fisheries (Total Allowable Commercial Catch) Notice (No 2) 2004 (Gazette 2004, p 2725).

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice replaces the Schedule of the principal notice, which sets the total allowable commercial catch for the fishstocks listed in that schedule. While the entire schedule is replaced by this notice (for ease of reference), only the following entries are substantively affected:

  • the TACC for BNS1 is reduced to 400 tonnes:

  • the TACC for BNS2 is reduced to 438 tonnes:

  • the TACC for BNS3 is reduced to 171 tonnes:

  • the TACC for BNS7 is reduced to 62 tonnes:

  • the TACC for BNS8 is reduced to 29 tonnes:

  • the TACC for GSH2 is increased to 89 tonnes (from that set in the Fisheries (Quota Management Areas, Total Allowable Catches, and Catch Histories) Notice 1986):

  • the TACC for GSH8 is increased to 34 tonnes (from that set in the Fisheries (Quota Management Areas, Total Allowable Catches, and Catch Histories) Notice 1986):

  • the TACC for ELE5 is increased to 170 tonnes:

  • the TACC for JDO7 is increased to 150 tonnes:

  • the TACC for GUR3 is increased to 1 100 tonnes:

  • the TACC for GUR7 is increased to 785 tonnes:

  • the TACC for MAK1 is reduced to 200 tonnes (from that set in the Fisheries (Total Allowable Commercial Catch) Notice (No 2) 2004):

  • the TACC for POR2 is increased to 18 tonnes (from that set in the Fisheries (Total Allowable Commercial Catch) Notice 2004):

  • the TACC for POS1 is reduced to 110 tonnes (from that set in the Fisheries (Total Allowable Commercial Catch) Notice (No 2) 2004):

  • the TACC for STN1 is increased to 817 tonnes (from that set in the Fisheries (Total Allowable Commercial Catch) Notice (No 2) 2004).

The notice comes into force on 30 September 2012 and applies to and from the fishing year starting on 1 October 2012.
