Taranaki Maori Trust Board Order 2012

Pursuant to section 55 of the Maori Trust Boards Act 1955, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

Order

1 Title
  • This order is the Taranaki Maori Trust Board Order 2012.

2 Commencement
  • This order comes into force on the day after the date of its notification in the Gazette.

3 Interpretation
4 Background
  • (1) The term of office of the previous members of the Board expired on 6 May 2012.

    (2) The Board held an election of new members that was completed on 3 September 2012.

    (3) However, the election was irregular because the Board did not comply with the following procedural requirements for conducting an election under the Act:

    • (a) the requirement under section 46 to give notice calling for nominations for election no later than 4 months before the term of office of the previous members expired (nominations were instead called for on 1 June 2012):

    • (b) the requirements under sections 46 and 47 to give notice that the latest date by which nominations were to be lodged was the date 3 months before the term of office of the previous members expired (the date was instead notified as 2 July 2012), and because no nominations were received on 2 July 2012 for the Ngāti Maru tribe, nominations were again called for on 20 July 2012 for the Ngāti Maru tribe:

    • (c) the requirement under section 49 to forward to the chief executive of Te Puni Kōkiri the names of the persons elected no later than 20 days before the term of office of the previous members expired (the names instead were forwarded on 11 September 2012).

5 Validation and appointment
  • Despite the irregularities specified in clause 4(3),—

    • (a) the 2012 election of members to the Board is, and always has been, valid; and

    • (b) the persons elected are appointed as members of the Board for the period of 3 years starting on the commencement of this order, as follows:

      • (i) the person named in Part 1 of the Schedule is appointed to represent the Atiawa tribe:

      • (ii) the person named in Part 2 of the Schedule is appointed to represent the Ngāti Mutunga tribe:

      • (iii) the person named in Part 3 of the Schedule is appointed to represent the Ngāti Maru tribe:

      • (iv) the person named in Part 4 of the Schedule is appointed to represent the Ngāti Tama tribe:

      • (v) the person named in Part 5 of the Schedule is appointed to represent the Ngāti Ruanui tribe:

      • (vi) the person named in Part 6 of the Schedule is appointed to represent the Ngāruahine tribe:

      • (vii) the person named in Part 7 of the Schedule is appointed to represent the Taranaki tribe:

      • (viii) the person named in Part 8 of the Schedule is appointed to represent the Ngārauru tribe.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order comes into force on the day after the date of its notification in the Gazette. The order validates the election of members to the Taranaki Maori Trust Board. The members were elected to represent the beneficiaries of Atiawa, Ngāti Mutunga, Ngāti Maru, Ngāti Tama, Ngāti Ruanui, Ngāruahine, Taranaki, and Ngārauru on the Board. The election was subject to the irregularities specified in clause 4(3).

The members are appointed for a term of 3 years starting on the date of the commencement of this order.
