Pursuant to section 2(2) of the Ngāti Whātua Ōrākei Claims Settlement Act 2012, His Excellency the Governor-General makes the following order,—

  • (a) acting on the advice and with the consent of the Executive Council; and

  • (b) being satisfied of the matter referred to in section 2(3) of that Act.

Order

1 Title
  • This order is the Ngāti Whātua Ōrākei Claims Settlement Act Commencement Order 2013.

2 Commencement of sections 54 and 55 of Ngāti Whātua Ōrākei Claims Settlement Act 2012
  • Sections 54 and 55 of the Ngāti Whātua Ōrākei Claims Settlement Act 2012 come into force on 8 February 2013.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order brings into force sections 54 and 55 of the Ngāti Whātua Ōrākei Claims Settlement Act 2012 (the Act) on 8 February 2013.

Section 54 of the Act revokes the reserve status of certain land, known as the Narrow Neck property, and section 55 of the Act removes the same land from the Hauraki Gulf Marine Park by way of amendment to the Hauraki Gulf Marine Park Act 2000. These amendments are necessary to give effect to the deed of settlement in relation to the transfer of the Narrow Neck property to Ngāti Whātua Ōrākei.
