Pursuant to section 89 of the Road User Charges Act 2012, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

Regulations

1 Title
  • These regulations are the Road User Charges Amendment Regulations 2013.

2 Commencement
  • These regulations come into force on 1 July 2013.

3 Principal regulations
4 Regulation 3 amended (Interpretation)
  • In regulation 3(1), insert in their appropriate alphabetical order:

    single large-tyred axle has the same meaning as in Part 2 of Land Transport Rule: Vehicle Dimensions and Mass 2002

    veteran motor vehicle has the same meaning as in regulation 3 of the Land Transport (Motor Vehicle Registration and Licensing) Regulations 2011

    vintage motor vehicle has the same meaning as in regulation 3 of the Land Transport (Motor Vehicle Registration and Licensing) Regulations 2011

    vintage powered vehicle means a powered vehicle that is—

    • (a) a veteran motor vehicle or vintage motor vehicle; and

    • (b) not used for any commercial purpose.

5 Regulation 4 amended (RUC vehicle types and RUC weight bands)
  • After regulation 4(2), insert:

    • (3) However, despite subclause (2), a type H vehicle that is carrying, rather than towing, a RUC vehicle that ordinarily forms part of the relevant combination vehicle—

      • (a) remains within its type H vehicle type number description; and

      • (b) an application under regulation 5 is not required.

    • (4) To avoid doubt, subclause (3) applies—

      • (i) whether the trailer is carried on the towing vehicle or on another trailer that forms part of the relevant combination vehicle; and

      • (ii) only if all components describing that type H vehicle are present.

6 Regulation 5 amended (Application to change assigned RUC vehicle type)
  • (1) In regulation 5(4)(b), replace 409, with 402, 403, 404,.

    (2) After regulation 5(4), insert:

    • (5) To avoid doubt, a specified RUC vehicle type that is a towing vehicle may, when unladen, be operated without any trailer.

7 Regulation 9 amended (Information that must be included on distance licence (except for type H vehicle))
  • Revoke paragraph (e).

8 Schedule amended
  • (1) In the Schedule, Part 1,—

    • (a) item relating to RUC vehicle type number 1, replace:

      RUC weight of more than 6 000 kg

        

      with:

        

      RUC weight of more than 6 000 kg but not more than 9 000 kg

      RUC weight of more than 9 000 kg

        
    • (b) item relating to RUC vehicle type number 14, third column, delete , 409,:

    • (c) item relating to RUC vehicle type number 308, replace Towing vehicle with 3 axles that is part of a combination vehicle with a total of 8 axles with Towing vehicle with 3 axles that is part of a combination vehicle with a total of at least 8 axles:

    • (d) item relating to RUC vehicle type number 408, replace Towing vehicle with 4 axles that is part of a combination vehicle with a total of 8 axles with Towing vehicle with 4 axles that is part of a combination vehicle with a total of at least 8 axles:

    • (e) item relating to RUC vehicle type number 309, replace “Towing vehicle with 3 axles that is part of a combination vehicle with a total of 9 axles” with Towing vehicle with 3 axles that is part of a combination vehicle with a total of at least 9 axles:

    • (f) revoke the item relating to RUC vehicle type number 409:

    • (g) after item relating to RUC vehicle type number 799, insert:

      Vintage powered vehicles

      RUC weight of more than 12 tonnes

    • (h) item relating to RUC vehicle type number 29, replace Unpowered vehicle with 2 twin-tyred close axles (except type 929 RUC vehicles) with Unpowered vehicle with 2 twin-tyred, or single large-tyred, close axles (except type 929 RUC vehicles):

    • (i) item relating to RUC vehicle type number 33, replace Unpowered vehicle with 3 twin-tyred close axles (except type 939 RUC vehicles) with Unpowered vehicle with 3 twin-tyred, or single large-tyred, close axles (except type 939 RUC vehicles):

    • (j) item relating to RUC vehicle type number 929, replace Leading trailer with 2 twin-tyred close axles with Leading trailer with 2 twin-tyred, or single large-tyred, close axles:

    • (k) item relating to RUC vehicle type number 939, replace Leading trailer with 3 twin-tyred close axles with Leading trailer with 3 twin-tyred, or single large-tyred, close axles.

    (2) In the Schedule, Part 2, above the item relating to Type H vehicle type number H61, insert:

    Towing vehicles part of 6 axle combinations

    (3) In the Schedule, Part 2, after the item relating to Type H vehicle type number H61, insert:

    H62 Towing vehicle that is part of an overweight combination vehicle consisting of a type 6 RUC vehicle towing a type 33 RUC vehicle with a permit weight of not more than 44 000 kg
    Towing vehicles part of 7 axle combinations

    (4) In the Schedule, Part 2, after the item relating to Type H vehicle type number H72, insert:

    H73 Towing vehicle that is part of an overweight combination vehicle consisting of a type 6 RUC vehicle towing a type 43 RUC vehicle with a permit weight of not more than 50 000 kg
    H74 Towing vehicle that is part of an overweight combination vehicle consisting of a type 6 RUC vehicle towing a type 43 RUC vehicle with a permit weight of not more than 53 000 kg

    (5) In the Schedule, Part 2, after the item relating to Type H vehicle type number H86, insert:

    H87 Towing vehicle that is part of an overweight combination vehicle consisting of a type 14 RUC vehicle towing a type 929 RUC vehicle and a type 29 RUC vehicle with a permit weight of not more than 48 000 kg

    (6) In the Schedule, Part 2,—

    • (a) item relating to Type H vehicle type number H91, replace 48 000 kg with 50 000 kg:

    • (b) item relating to Type H vehicle type number H92,—

      • (i) replace 48 000 kg with 50 000 kg; and

      • (ii) replace 53 000 kg with 54 000 kg:

    • (c) item relating to Type H vehicle type number H93, replace 53 000 kg with 54 000 kg:

    • (d) item relating to Type H vehicle type number H94, replace 48 000 kg with 50 000 kg:

    • (e) item relating to Type H vehicle type number H95,—

      • (i) replace 48 000 kg with 50 000 kg; and

    • (i) item relating to Type H vehicle type number H99, replace 53 000 kg with 54 000 kg.

    (7) In the Schedule, Part 2, after the item relating to Type H vehicle type number H99, insert:

    H30 Towing vehicle that is part of an overweight combination vehicle consisting of a type 14 RUC vehicle towing a type 929 RUC vehicle and a type 33 RUC vehicle with a permit weight of not more than 50 000 kg
    H31 Towing vehicle that is part of an overweight combination vehicle consisting of a type 14 RUC vehicle towing a type 929 RUC vehicle and a type 33 RUC vehicle with a permit weight of more than 50 000 kg but not more than 54 000 kg
    H32 Towing vehicle that is part of an overweight combination vehicle consisting of a type 14 RUC vehicle towing a type 929 RUC vehicle and a type 33 RUC vehicle with a permit weight of more than 54 000 kg but not more than 58 000 kg

    (8) In the Schedule, Part 2, revoke the item relating to Type H vehicle type number H10.

    (9) In the Schedule, Part 2, replace the items relating to Type H vehicle type numbers H11 and H12 with:

    H11 Towing vehicle that is part of an overweight combination vehicle consisting of a type 14 RUC vehicle towing a type 939 RUC vehicle and a type 33 RUC vehicle with a permit weight of not more than 55 000 kg
    H12 Towing vehicle that is part of an overweight combination vehicle consisting of a type 14 RUC vehicle towing a type 939 RUC vehicle and a type 33 RUC vehicle with a permit weight of more than 55 000 kg but not more than 60 000 kg

    (10) In the Schedule, Part 2, revoke the item relating to Type H vehicle type number H13.

    (11) In the Schedule, Part 2, replace the items relating to Type H vehicle type numbers H14 to H19 with:

    H14 Towing vehicle that is part of an overweight combination vehicle consisting of a type 6 RUC vehicle towing a type 43 RUC vehicle and a type 33 RUC vehicle with a permit weight of not more than 55 000 kg
    H15 Towing vehicle that is part of an overweight combination vehicle consisting of a type 6 RUC vehicle towing a type 43 RUC vehicle and a type 33 RUC vehicle with a permit weight of more than 55 000 kg but not more than 60 000 kg
    H36 Towing vehicle that is part of an overweight combination vehicle consisting of a type 19 RUC vehicle towing a type 951 RUC vehicle with a permit weight of not more than 55 000 kg

    H18 Towing vehicle that is part of an overweight combination vehicle consisting of a type 14 RUC vehicle towing a type 43 RUC vehicle and a type 33 RUC vehicle with a permit weight of more than 55 000 kg but not more than 60 000 kg
    H19 Towing vehicle that is part of an overweight combination vehicle consisting of a type 14 RUC vehicle towing a type 43 RUC vehicle and a type 33 RUC vehicle with a permit weight of more than 60 000 kg but not more than 63 000 kg

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 July 2013, amend the Road User Charges Regulations 2012 by—

  • inserting new definitions of single large-tyred axle, veteran motor vehicle, vintage motor vehicle, and vintage powered vehicle:

  • making special provision in relation to type H vehicles that, when unladen, carry, rather than tow, a RUC vehicle that ordinarily forms part of the relevant combination vehicle:

  • providing that, to avoid doubt, a specified RUC vehicle that is also a towing vehicle may, when unladen, be operated without any trailer:

  • revoking regulation 9(e), which means that RUC weight for the RUC vehicle to which a distance licence relates is no longer required to be included on the distance licence:

  • changing certain RUC weight bands and descriptions in the Schedule.
