Road User Charges (Classes of RUC Vehicles) Exemption Amendment Order 2013

Pursuant to section 38 of the Road User Charges Act 2012, His Excellency the Governor-General makes the following order, acting—

  • (a) on the advice and with the consent of the Executive Council; and

  • (b) on the recommendation of the Minister of Transport after having been satisfied of the matters referred to in section 38(2) of that Act.

1 Title
  • This order is the Road User Charges (Classes of RUC Vehicles) Exemption Amendment Order 2013.

2 Commencement
  • This order comes into force on 1 June 2013.

3 Principal order
4 Section 3 amended (Interpretation)
  • In regulation 3(1), replace the definition of tractor with:

    tractor means a motor vehicle (other than a traction engine) that is designed and constructed, and not merely adapted, for traction and powering implements.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 1 June 2013, amends the Road User Charges (Classes of RUC Vehicles) Exemption Order 2012.

The amendment replaces the definition of tractor. The new definition omits the reference to not exceeding 40 km per hour on the road. This means that all tractors designed and constructed, and not merely adapted, for traction and powering implements are exempt from road user charges.
