Pursuant to section 79(1) of the Summary Proceedings Act 1957, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

Order

1 Title
  • This order is the Summary Proceedings (Orders of Reparation) Amendment Order 2013.

2 Commencement
  • This order comes into force on 1 July 2013.

3 Principal order
4 Schedule amended
  • (1) In the Schedule, after the item relating to the Crimes Act 1961, insert:

    Criminal Procedure Act 2011 (2011 No 81)

    Section 377(2).

    (2) In the Schedule, replace the item relating to the Student Loan Scheme Act 1992 with:

    Student Loan Scheme Act 2011 (2011 No 62)

    Section 163(3).

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 1 July 2013, amends the Summary Proceedings (Orders of Reparation) Order 2011 (the principal order). The amendment makes a consequential change that is required as a result of the regime introduced by the Criminal Procedure Act 2011. The principal order declares certain court orders made under specified enactments to be orders of reparation. This order adds a reference to the provision in the Criminal Procedure Act 2011 that deals with restitution of property. It also updates a cross-reference.
