Pursuant to section 100G of the Biosecurity Act 1993, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

Order

1 Title
  • This order is the Biosecurity (National Bovine Tuberculosis Pest Management Plan) Amendment Order 2013.

2 Commencement
  • This order comes into force on 1 July 2013.

3 Principal order
4 Clause 2 amended (Interpretation)
  • (1) In clause 2(1), revoke the definition of Board.

    (2) In clause 2(1), insert in its appropriate alphabetical order:

    TBfree New Zealand means TBfree New Zealand Limited.

    (3) In clause 2(1), definition of tuberculosis vector free area, replace the Board with TBfree New Zealand (or, before 1 July 2013, by the Animal Health Board (Incorporated)).

    (4) In clause 2(1), definition of tuberculosis vector risk area, replace the Board with TBfree New Zealand (or, before 1 July 2013, by the Animal Health Board (Incorporated)).

    (5) In clause 2(1), definition of vector, replace the Board with TBfree New Zealand.

5 Clause 6 amended (Management agency)
  • In clause 6, replace the Animal Health Board (Incorporated) with TBfree New Zealand.

6 Clause 10 amended (Obligation to notify Board of place where herd is kept)
  • (1) In the heading to clause 10, replace Board with TBfree New Zealand.

    (2) In clause 10(1), replace the Board with TBfree New Zealand.

7 Clause 12C amended (Form and content of declarations)
  • (1) In clause 12C(1)(a), replace the Board with TBfree New Zealand (or, if the form of the declaration was approved before 1 July 2013, the Animal Health Board (Incorporated)).

    (2) Replace clause 12C(1)(c)(ii) with:

    • (ii) the herd identification number of the herd from which the animal is being moved as given to that herd in accordance with the identification system approved by the Director, Preparedness and Partnerships, on 22 June 2012 for the purposes of bovine tuberculosis control, marking the presence or absence in organisms of particular qualities, and meeting the certification requirements of overseas authorities and notified in the Gazette on 28 June 2012 at 2074 (or any other identification system that is approved in its place):.

    (3) In clause 12C(1)(c)(vii), replace the Board with TBfree New Zealand (or, if the status was assigned before 1 July 2013, the Animal Health Board (Incorporated)).

8 Clause 14A amended (Obligation of persons performing ante- and post-mortem examinations to submit specimens for investigation)
  • In clause 14A(2)(c), replace the Board with TBfree New Zealand (or, if the form of the records was approved before 1 July 2013, the Animal Health Board (Incorporated)).

9 Clause 14B amended (Obligation of persons in charge of verifying compliance with ante- and post-mortem examination procedures)
  • In clause 14B(1)(b), replace the Board with TBfree New Zealand (or, if the form of the records was approved before 1 July 2013, the Animal Health Board (Incorporated)).

10 Clause 15 amended (Obligation of laboratories to provide results)
  • In clause 15(1), replace the Board with TBfree New Zealand.

11 Clause 15A amended (Obligation of operator of commercial slaughter premises)
  • (1) In clause 15A(5)(a), replace the Board with TBfree New Zealand.

    (2) In clause 15A(5)(b), replace the Board with TBfree New Zealand (or, if the form of the report was approved before 1 July 2013, the Animal Health Board (Incorporated)).

    (3) In clause 15A(6), replace the Board with TBfree New Zealand in each place.

12 Clause 16 amended (Obligation to supply information)
  • (1) In clause 16(2), replace The Board with TBfree New Zealand.

13 Clause 17 amended (Obligation to report suspected presence of bovine tuberculosis to Board)
  • (1) In the heading to clause 17, replace Board with TBfree New Zealand.

    (2) In clause 17(1), replace the Board with TBfree New Zealand.

    (3) In clause 17(2), replace the Board with TBfree New Zealand.

14 Clause 17A amended (Release of pigs into wild state)
15 Clause 19 amended (Funding of plans)
  • (1) In clause 19(b), replace the Board with the Animal Health Board (Incorporated) (which was replaced as the management agency by TBfree New Zealand on 1 July 2013).

    (2) Replace clause 19(e) with:

    • (e) by payments made by Deer Industry New Zealand (established under the Deer Industry New Zealand Regulations 2004) in accordance with the funding agreement, dated 15 December 2003, between the Animal Health Board (Incorporated) (which was replaced as the management agency by TBfree New Zealand on 1 July 2013) and the Game Industry Board (which was replaced by Deer Industry New Zealand on 21 October 2004) (or any agreement that replaces that agreement):.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 1 July 2013, amends the Biosecurity (National Bovine Tuberculosis Pest Management Plan) Order 1998. With 2 exceptions, all references to the Animal Health Board (Incorporated) are replaced by references to TBfree New Zealand Limited, which is the new management agency for the purposes of the Biosecurity (National Bovine Tuberculosis Pest Management Plan) Order 1998.

References to the Game Industry Board are also updated to refer to Deer Industry New Zealand, the marketing authority that replaced it.
