His Excellency the Governor-General in Council

Pursuant to the Adoption Act 1955, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.


1 Title
  • These regulations are the Adoption Amendment Regulations 2013.

2 Commencement
  • These regulations come into force on 19 August 2013.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 19 August 2013, update the application form and other forms in the Adoption Regulations 1959. The updating is necessary to ensure that the language in the forms reflects the fact that, when the Marriage (Definition of Marriage) Amendment Act 2013 comes into force, same-sex marriages will be possible. Since married couples are eligible to adopt under the Adoption Act 1955, the regulations need to provide for the possibility of adoption by a same-sex married couple.
