Health Practitioners (Quality Assurance Activity—Auckland DHB) Notice 2013

Pursuant to section 54 of the Health Practitioners Competence Assurance Act 2003, the Minister of Health, being satisfied of the matters set out in section 54(3) of that Act, gives the following notice.

1 Title
  • This notice is the Health Practitioners (Quality Assurance Activity—Auckland DHB) Notice 2013.

2 Commencement
  • This notice comes into force on the day after the date of its notification in the Gazette.

3 Declaration of protected quality assurance activity
  • The Auckland DHB quality assurance activity described in the Schedule is protected.

Description of Auckland DHB quality assurance activity

1 Interpretation
  • In this schedule,—

    activity means the Auckland DHB quality assurance activity described in clause 4

    participant means a health practitioner employed by, or providing clinical services to, the Auckland DHB.

2 Objective
  • The objective of the activity is to improve the practices and competence of participants by assessing the clinical care provided by individual participants through clinical case reviews and audits in order to improve patient outcomes.

3 Information
  • The activity is based on information derived from participants.

4 Activity
  • The activity involves—

    • (a) assessing the clinical care provided by individual participants by—

      • (i) reviewing clinical case notes, including laboratory, imaging, and other supporting information; and

      • (ii) presenting cases to participants; and

      • (iii) discussing cases; and

      • (iv) holding clinical audit meetings of cases; and

      • (v) undertaking peer reviews of clinical practices; and

    • (b) making recommendations on how participants can improve their performance; and

    • (c) monitoring the implementation of any such recommendations.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on the day after the date of its notification in the Gazette, declares the Auckland DHB quality assurance activity to be a protected quality assurance activity. The effect of this declaration is that—

  • any information that becomes known solely as a result of the activity is confidential; and

  • any documents brought into existence solely for the purposes of the activity are confidential; and

  • people who engage in the activity in good faith are immune from civil liability.

The protections afforded by this notice are subject to certain statutory exceptions. For example, this notice does not prohibit the disclosure of information that does not identify, either expressly or by implication, a particular individual.

Under section 54(4) of the Health Practitioners Competence Assurance Act 2003, this notice remains in force for a period of 5 years after the date on which it is issued, unless it is sooner revoked.
