These regulations are administered by the Ministry for Primary Industries.

Pursuant to section 297(1)(h) of the Fisheries Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

Regulations

1 Title

These regulations are the Fisheries (Reporting) Amendment Regulations 2013.

2 Commencement

These regulations come into force on 1 October 2013.

3 Principal regulations

These regulations amend the Fisheries (Reporting) Regulations 2001 (the principal regulations).

4 Schedule 3, Part 6 amended

(1)

In Schedule 3, Part 6, item relating to destination type code D, replace “accidently” with “accidentally”.

(2)

In Schedule 3, Part 6, item relating to destination type code A, replace “, or abandoned in, or accidentally lost at, sea” with “the sea, abandoned in the sea, or accidentally lost at sea, except for fish or fish product to which another destination type code applies”.

In Schedule 3, Part 6, after the item relating to destination type code X, insert:

Fish or fish products of the species or classes of fish subject to the quota management system established under Part 4 of the Act that are returned to, or abandoned in, the sea in accordance with the requirements set out in section 72(5)(c)(i) to (iii) of the ActJ
5 Schedule 3, Part 8 amended

In Schedule 3, Part 8, after the item relating to diving, insert:

Diving utilising self-contained underwater breathing apparatusUBA
Diving utilising surface-supplied underwater breathing apparatusUBS

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 October 2013, amend Schedule 3 of the Fisheries (Reporting) Regulations 2001.

The regulations amend Part 6 of Schedule 3 by—

  • amending the destination description for destination type code A to clarify that fish and fish products to which another destination type code applies are not within the scope of destination type code A:

  • inserting a new destination type code that describes the manner in which fish or fish products are disposed of. The new code, destination type code J, applies to fish or fish products returned to, or abandoned in, the sea in accordance with the requirements set out in section 72(5)(c)(i) to (iii) of the Fisheries Act 1996 (commonly known as observer-authorised discards):

  • amending the destination description for destination type code D to correct an error.

The regulations amend Part 8 of Schedule 3 by inserting 2 new method codes relating to the use of underwater breathing apparatus.
