Health Practitioners (Quality Assurance Activity—ANZCA Trainee Portfolio System—Cases and Procedures) Notice 2013

Pursuant to section 54 of the Health Practitioners Competence Assurance Act 2003, the Minister of Health, being satisfied of the matters set out in section 54(3) of that Act, gives the following notice.

1 Title
  • This notice is the Health Practitioners (Quality Assurance Activity—ANZCA Trainee Portfolio System—Cases and Procedures) Notice 2013.

2 Commencement
  • This notice comes into force on the day after the date of its notification in the Gazette.

3 Declaration of protected quality assurance activity
  • The ANZCA Trainee Portfolio System—Cases and Procedures described in the Schedule is protected.


Schedule
Description of ANZCA Trainee Portfolio System—Cases and Procedures

1 Interpretation
  • In this schedule,—

    activity means the ANZCA Trainee Portfolio System—Cases and Procedures

    ANZCA means the Australian and New Zealand College of Anaesthetists

    participant means a health practitioner who is participating in the activity.

2 Objective
  • The objective of the activity is to improve patient outcomes by improving the clinical practices of the participants.

3 Information
  • The activity is based on information derived from the participants.

4 Activity
  • The activity involves—

    • (a) collecting and logging information from participants' clinical experience; and

    • (b) sharing that information with the ANZCA Education and Training Committee for the purpose of allowing that committee to oversee the activity; and

    • (c) identifying clinical areas where participants require further training and development; and

    • (d) monitoring and assessing participants; and

    • (e) making recommendations on how to improve—

      • (i) the activity; and

      • (ii) the overall quality and safety of anaesthesia and pain medicine for patients.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on the day after the date of its notification in the Gazette, declares the ANZCA Trainee Portfolio System—Cases and Procedures to be a protected quality assurance activity. The effect of this declaration is that—

  • any information that becomes known solely as a result of the activity is confidential; and

  • any documents brought into existence solely for the purposes of the activity are confidential; and

  • people who engage in the activity in good faith are immune from civil liability.

The protections afforded by this notice are subject to certain statutory exceptions. For example, this notice does not prohibit the disclosure of information that does not identify, either expressly or by implication, a particular individual.

Under section 54(4) of the Health Practitioners Competence Assurance Act 2003, this notice remains in force for a period of 5 years after the date on which it is issued, unless it is sooner revoked.
