This order is administered by the Ministry of Transport.

Pursuant to section 333(1) of the Maritime Transport Act 1994, Her Excellency the Administrator of the Government, acting on the advice and with the consent of the Executive Council and on the recommendation of the Minister (whose recommendation has been made in accordance with section 333(4) of that Act), makes the following order.

Order

1 Title

This order is the Maritime Transport (Oil Pollution Levies) Amendment Order 2013.

2 Commencement

This order comes into force on the day after the date of its notification in the Gazette.

3 Principal order

This order amends the Maritime Transport (Oil Pollution Levies) Order 2013 (the principal order).

4 Interpretation

In clause 3(1), replace the definition of persistent oil with:

persistent oil means crude oil, fuel oil, lubricating oil, heavy diesel oil, or any other persistent oil

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on the day after the date of its notification in the Gazette, amends the Maritime Transport (Oil Pollution Levies) Order 2013 (the principal order).

This order replaces the principal order’s definition of persistent oil. The replacement definition is the definition from the order that the principal order replaced, namely, the Oil Pollution Levies Order 1998 (the 1998 order).

The effect of the amendment is to provide a more comprehensive definition that is well understood and covers all the oil that is required to be levied under the principal order.
