Health Practitioners (Quality Assurance Activity—BreastSurgANZ Quality Audit) Notice 2014

Pursuant to section 54 of the Health Practitioners Competence Assurance Act 2003, the Minister of Health, being satisfied of the matters set out in section 54(3) of that Act, gives the following notice.

Notice

1 Title
  • This notice is the Health Practitioners (Quality Assurance Activity—BreastSurgANZ Quality Audit) Notice 2014.

2 Commencement
  • This notice comes into force on the day after the date of its notification in the Gazette.

3 Revocation of this notice
  • This notice is revoked at the end of the period for which it remains in force under section 54(4) of the Health Practitioners Competence Assurance Act 2003.

4 Declaration of protected quality assurance activity
  • The BreastSurgANZ Quality Audit described in the Schedule is a protected quality assurance activity.


Schedule
Description of BreastSurgANZ Quality Audit

1 Interpretation
  • In this schedule,—

    activity means the BreastSurgANZ Quality Audit described in clause 4

    participant means—

    • (a) full members of Breast Surgeons of Australia & New Zealand Incorporated:

    • (b) surgeons who are involved in the treatment in Australia or New Zealand of early breast cancer who pay a fee to access the BreastSurgANZ Quality Audit.

2 Objective
  • The objective of the activity is to ensure that the highest possible standard of surgical care and management is given by participants to patients in Australia and New Zealand with early breast cancer.

3 Information
  • The activity is based on information derived from participants.

4 Activity
  • (1) The activity is undertaken by the Breast Surgeons of Australia & New Zealand Incorporated in collaboration with persons employed or engaged by the Royal Australasian College of Surgeons.

    (2) The activity involves—

    • (a) collecting from participants clinical and pathological data about patients with early breast cancer; and

    • (b) collating and analysing the data collected under paragraph (a); and

    • (c) applying bi-national standards and clinical guidelines to the data collected under paragraph (a) to evaluate the surgical care and management performance of participants; and

    • (d) providing individual participants with feedback on the evaluation undertaken under paragraph (c); and

    • (e) making recommendations on how participants may improve their performance to ensure that patients are provided with the highest possible standard of surgical care and management; and

    • (f) facilitating and monitoring any recommendation made under paragraph (e).

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice comes into force on the day after the date of its notification in the Gazette. It declares the BreastSurgANZ Quality Audit described in the Schedule to be a protected quality assurance activity. The effect of this declaration is that—

  • any information that becomes known solely as a result of the activity is confidential; and

  • any documents brought into existence solely for the purposes of the activity are confidential; and

  • the persons who engage in the activity in good faith are immune from civil liability.

The protections afforded by this notice are subject to certain statutory exceptions. For example, this notice does not prohibit the disclosure of information that does not identify, either expressly or by implication, a particular individual.

Under section 54(4) of the Health Practitioners Competence Assurance Act 2003, this notice remains in force for a period of 5 years after the date on which it is issued, unless it is revoked before then.

This notice revokes the Health Practitioners (Quality Assurance Activity—National Breast Cancer Audit) Notice 2011.
