Student Allowances Amendment Regulations (No 2) 2014

Pursuant to section 303 of the Education Act 1989, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

Regulations

1 Title
  • These regulations are the Student Allowances Amendment Regulations (No 2) 2014.

2 Commencement
  • These regulations come into force on 14 April 2014.

3 Principal regulations
4 Regulation 9 amended (Eligibility for accommodation benefit)
  • Replace regulation 9(2)(aa) with:

    • (aa) students who are applicable persons in respect of social housing (as the terms applicable person and social housing are defined in section 2 of the Housing Restructuring and Tenancy Matters Act 1992):.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 14 April 2014, amend the Student Allowances Regulations 1998 (the principal regulations) as a consequence of the Social Housing Reform (Housing Restructuring and Tenancy Matters Amendment) Act 2013.

Under regulation 9(2)(aa) of the principal regulations, students who are applicable persons in respect of HNZ housing are not eligible for an accommodation benefit. The effect of this amendment is that students who are applicable persons in respect of social housing (which means housing provided by HNZ or registered community housing providers) are not eligible for an accommodation benefit.
