Fisheries (South Island Customary Fishing) Notice (No 3) 2014

Pursuant to regulations 9 and 10 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Deputy Director-General Māori Primary Sector Partnerships of the Ministry for Primary Industries (acting pursuant to a delegation from the Director-General of the Ministry for Primary Industries under the State Sector Act 1988), after compliance with the requirements set out in regulations 9 and 10 of those regulations, gives the following notice.

1 Title
  • This notice is the Fisheries (South Island Customary Fishing) Notice (No 3) 2014.

2 Commencement
  • This notice comes into force on the day after the date of its notification in the Gazette.

3 Interpretation
4 Appointments cancelled
  • (1) The appointments of Murray Robert Lindsay and Tony Ropata as Tangata Tiaki/Kaitiaki of the area/rohe moana are cancelled.

    (2) The cancellations described in subclause (1) took effect at the close of 15 April 2014.

5 New appointments
  • (1) Rachel Wesley and Stephen Bryant are appointed as Tangata Tiaki/Kaitiaki of the area/rohe moana under regulation 10(2) of the regulations.

    (2) The appointments described in subclause (1)—

    • (a) took effect on 16 April 2014; and

    • (b) expire at the close of 15 April 2019.

6 Reappointments
  • (1) The following persons are appointed as Tangata Tiaki/Kaitiaki of the area/rohe moana under regulation 9(5) of the regulations:

    • (a) Graeme Fraser:

    • (b) Hoani Langsbury:

    • (c) Paul Ropata:

    • (d) Tangi Russell:

    • (e) Trevor Griffin.

    (2) The appointments described in subclause (1)—

    • (a) took effect on 16 April 2014; and

    • (b) expire at the close of 15 April 2019.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on the day after the date of its notification in the Gazette, is made under the Fisheries (South Island Customary Fishing) Regulations 1999 (the regulations). This notice relates to the area/rohe moana for which Te Rūnanga o Ōtākou represents the whānau and hapū of Ngāi Tahu Whānui who hold manawhenua and manamoana. It gives notice of—

  • the cancellation of previous appointments of persons as Tangata Tiaki/Kaitiaki:

  • the appointment of replacement Tangata Tiaki/Kaitiaki for 5-year terms under regulation 10(2) of the regulations:

  • the reappointment of existing Tangata Tiaki/Kaitiaki for further 5-year terms under regulation 9(5) of the regulations.

A Tangata Tiaki/Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1996 for customary food-gathering purposes within the whole or any part of the area/rohe moana. It is an offence to take any of those resources for customary food-gathering purposes without such authorisation.

This notice is the first notice made under the regulations to be published in the Legislative Instruments series. Two previous notices made in 2014 have been published in the Gazette. These are the—
