Fisheries (Interim and Annual Deemed Values) Notice 2003 Amendment Notice 2014: revoked, on 29 September 2015, pursuant to clause 9(1) of the Fisheries (Total Allowable Catch, Total Allowable Commercial Catch, and Deemed Value Rates) Notice 2015 (LI 2015/211).

This notice is administered by the Ministry for Primary Industries.

Pursuant to section 75 of the Fisheries Act 1996, the Minister for Primary Industries gives the following notice after complying with sections 75 and 75A of that Act.

Notice

1 Title

This notice is the Fisheries (Interim and Annual Deemed Values) Notice 2003 Amendment Notice 2014.

2 Commencement

This notice comes into force on 30 September 2014.

3 Application

This notice applies on and from the first day of the fishing year starting on 1 October 2014.

4 Principal notice

This notice amends the Fisheries (Interim and Annual Deemed Values) Notice 2003 (the principal notice).

5 Clause 7 amended (Different deemed values for Chatham Islands)

(1)

After clause 7(1), insert:

(1A)

Clause 6(ab) applies to stocks landed in and received by a licensed fish receiver located in the Chatham Islands as if—

(a)

a reference in that clause to Schedule 1 were a reference to Schedule 2; and

(b)

a reference in that clause to Schedule 1A were a reference to Schedule 3.

(2)

Revoke clause 7(3).

6 Clause 7A amended (Values exclusive of GST)

In clause 7A(2), replace “Schedule 1, and the Chatham Islands deemed values specified in Schedule 2” with “the schedules”.

7 Schedule 1 amended

In Schedule 1, replace the item relating to fishstock code ORH7A with the item set out in Schedule 1 of this notice.

8 Schedule 1A amended

In Schedule 1A, replace the item relating to fishstock code ORH3B with the item set out in Schedule 2 of this notice.

9 Schedule 2 amended

In Schedule 2, replace the item relating to fishstock code BNS3 with the item set out in Schedule 3 of this notice.

10 New Schedule 3 inserted

After Schedule 2, insert the Schedule 3 set out in Schedule 4 of this notice.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice amends the Fisheries (Interim and Annual Deemed Values) Notice 2003. It comes into force on 30 September 2014, but applies on and from the first day of the fishing year starting on 1 October 2014.

The amendments make the following changes for orange roughy with fishstock code ORH7A:

  • the interim deemed value is increased from $1.60/kg to $2.50/kg:

  • the annual deemed value is increased from $3.20/kg to $5.00/kg:

  • new differential annual deemed values for different levels of catch are applied (the same as apply to ORH3B).

The amendments make the following changes for bluenose with fishstock code BNS3 that is landed in and received by a licensed fish receiver located in the Chatham Islands:

  • the interim deemed value is increased from $0.53/kg to $0.95/kg:

  • the annual deemed value remains at $1.05/kg:

  • new differential annual deemed values for different levels of catch are applied.
