Instant Kiwi (Instant Game) Amendment Rules 2014

Pursuant to section 243 of the Gambling Act 2003, the New Zealand Lotteries Commission (Lotto New Zealand) makes the following rules after approval by the Minister of Internal Affairs.

Rules

1 Title
  • These rules are the Instant Kiwi (Instant Game) Amendment Rules 2014.

2 Commencement
  • These rules come into force on 1 November 2014.

3 Principal rules
4 Rule 2 amended (Interpretation)
  • (1) In rule 2, replace the definition of Act with:

    Act means the Gambling Act 2003.

    (2) In rule 2, definition of Commission, replace established under section 72 of the Act with continued under section 236 of the Act.

    (3) In rule 2, revoke the definition of mail order retailer.

5 Rule 8 revoked (Purchase of ticket by post or other delivery service)
6 Rule 20 replaced (Additional prizes)
  • Replace rule 20 with:

    20 Additional prizes
    • (1) The Commission may from time to time determine additional prizes to be distributed in accordance with a New Zealand lottery or a New Zealand prize competition, entry to which is limited to any particular class of player determined by the Commission.

      (2) A sum or sums of money from any additional prizes must be allocated from the Prize Reserve Fund.

7 Rule 25 amended (Claims made directly to Commission)

Explanatory note

This note is not part of the rules, but is intended to indicate their general effect.

These rules, which come into force on 1 November 2014, amend the Instant Kiwi (Instant Game) Rules 1992 to—

  • remove a player’s ability to make selections by post or other delivery service; and

  • allow additional prizes to be distributed to any class of player determined by the New Zealand Lotteries Commission; and

  • delete the reference to Wellington as the location of the Commission’s head office; and

  • improve consistency with rules for other similar games.

These rules are a legislative instrument and a disallowable instrument for the purposes of the Legislation Act 2012 and must be presented to the House of Representatives under section 41 of the Act.
