Fisheries (Maunganui Bay Temporary Closure) Notice 2014

Pursuant to section 186A of the Fisheries Act 1996, the Minister for Primary Industries, after complying with the requirements of that section, gives the following notice.

Notice

1 Title
  • This notice is the Fisheries (Maunganui Bay Temporary Closure) Notice 2014.

2 Commencement
  • This notice comes into force on 1 December 2014.

3 Revocation of this notice
  • This notice is revoked on the close of 29 October 2016.

4 Maunganui Bay closed in respect of any species of fish, aquatic life, or seaweed (except kina) for 2 years
  • (1) A person must not take any species of fish, aquatic life, or seaweed (except kina) from Maunganui Bay while this notice is in force.

    (2) In this clause,—

    kina

    • (a) means a shellfish of the species Evechinus chloroticus (also known as sea egg); and

    • (b) includes the purple urchin of the species Centrostephanus rodgersii

    Maunganui Bay means all those New Zealand fisheries waters enclosed by a line—

    • (a) commencing at Kariparipa Point (at 35°11.33′S and 174°17.59′E); then

    • (b) proceeding in a straight line to the north-westernmost point of the rocks west of Kariparipa Point (at 35°11.36′S and 174°17.51′E); then

    • (c) proceeding in a straight line in a generally south-westerly direction to a point off the west side of Motuwheteke Island (at 35°12.01′S and 174°17.28′E); then

    • (d) proceeding in a straight line in a generally southerly direction to a point on the rocks outside the south entrance of Maunganui Bay (at 35°12.26′S and 174°17.32′E); then

    • (e) proceeding in a straight line due east to the mean high-water mark; then

    • (f) proceeding along the mean high-water mark to the point of commencement.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on 1 December 2014, prohibits the taking of fish, aquatic life, or seaweed (except kina) from Maunganui Bay. In accordance with section 186A(5)(a) of the Fisheries Act 1996, this notice may not be in force beyond 2 years after the date of its notification in the Gazette. Accordingly, this notice is revoked on the close of 29 October 2016.
