  • (b) on the recommendation of the Minister for Climate Change Issues made after complying with the requirements in sections 163(5) and 166(1) of that Act.

Regulations

1 Title
  • These regulations are the Climate Change (Liquid Fossil Fuels) Amendment Regulations 2014.

2 Commencement
  • These regulations come into force on 4 March 2015.

3 Application
  • These regulations apply from 31 December 2014.

4 Principal regulations
5 Schedule amended
  • In the Schedule, replace the item relating to automotive and marine diesel with:

Automotive and marine diesel, as per regulation 4(1)(c) and (d)2.685

Michael Webster,
Clerk of the Executive Council.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations amend the Climate Change (Liquid Fossil Fuels) Regulations 2008 by increasing the default emission factor for automotive and marine diesel prescribed in the Schedule of those regulations from 2.670 tCO2e/kl to 2.685 tCO2e/kl. The regulations come into force on 4 March 2015, but apply from 31 December 2014 because section 166(3) of the Climate Change Response Act 2002 provides that regulations made under section 163 of that Act may come into force no earlier than 3 months after the date of their notification in the Gazette, while section 163(3) of that Act allows the regulations to apply in respect of a period after any particular date within the year in which they are made.

Issued under the authority of the Legislation Act 2012.

Date of notification in Gazette: 4 December 2014.

These regulations are administered by the Ministry for the Environment.
