Fisheries (Notification of Waihōpai Rūnaka Tangata Tiaki/Kaitiaki) Notice 2014

Pursuant to regulation 9 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Director-General of the Ministry for Primary Industries, after compliance with the requirements of that provision, gives the following notice.

1 Title
  • This notice is the Fisheries (Notification of Waihōpai Rūnaka Tangata Tiaki/Kaitiaki) Notice 2014.

2 Commencement
  • This notice comes into force on the day after the date of its notification in the Gazette.

3 Revocation of this notice
  • This notice is revoked at the close of 4 November 2019.

4 Customary food gathering area/rohe moana
  • This notice applies to the customary food gathering area/rohe moana from Piopiotahi (Milford Sound) to Tokatā (the Nuggets), extending seaward to the limit of the South Island fisheries waters and inland to the boundaries of the takiwā of the following rūnanga (as described in the Schedule of the Te Runanga o Ngai Tahu (Declaration of Membership) Order 2001):

    • (a) the Hokonui Rūnaka:

    • (b) Te Rūnanga o Awarua:

    • (c) Te Rūnanga o Ōraka Aparima:

    • (d) the Waihōpai Rūnaka.

5 Reappointment
  • (1) The Minister for Primary Industries has appointed Carol York-Pakinga for a further term as a Tangata Tiaki/Kaitiaki of the customary food gathering area/rohe moana.

    (2) The appointment—

    • (a) took effect on 5 November 2014; and

    • (b) expires at the close of 4 November 2019.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on the day after the date of its notification in the Gazette, is made under regulation 9 of the Fisheries (South Island Customary Fishing) Regulations 1999 (the regulations). It is revoked at the close of 4 November 2019.

The notice relates to a customary food gathering area/rohe moana of which the members of the Waihōpai Rūnaka are the tangata whenua. It gives notice of the Minister for Primary Industries’ decision to reappoint Carol York-Pakinga for a further term as a Tangata Tiaki/Kaitiaki of the area/rohe moana.

The Minister made the decision at the request of the Waihōpai Rūnaka, in accordance with regulation 9(5) of the regulations.

Tangata Tiaki/Kaitiaki may, within their area/rohe moana, authorise individuals to take, for customary food gathering purposes, fisheries resources managed under the Fisheries Act 1996. It is an offence to take those resources for customary food gathering purposes without such authorisation.
