Fisheries (Notification of Te Ngāi Tūāhuriri Rūnanga Tangata Tiaki/Kaitiaki) Notice 2014

Pursuant to regulations 9 and 10 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Director-General of the Ministry for Primary Industries, after compliance with the requirements of those provisions, gives the following notice.

Notice

1 Title
  • This notice is the Fisheries (Notification of Te Ngāi Tūāhuriri Rūnanga Tangata Tiaki/Kaitiaki) Notice 2014.

2 Commencement
  • This notice comes into force on the day after the date of its notification in the Gazette.

3 Revocation of this notice
  • This notice is revoked at the close of 15 November 2019.

4 Customary food gathering area/rohe moana
  • This notice applies to the customary food gathering area/rohe moana defined in clause 2(c) of the Fisheries (South Island Customary Fishing) Notice (No. 16) 2009 (Gazette 2009, p 4042).

5 Appointments cancelled
  • (1) The Minister for Primary Industries has cancelled the appointments of Ben Te Aika and Justin Fowler as Tangata Tiaki/Kaitiaki of the customary food gathering area/rohe moana.

    (2) The cancellations took effect at the close of 8 October 2014.

6 New appointments
  • (1) The Minister for Primary Industries has appointed Tania Waati and Te Maire Tau as Tangata Tiaki/Kaitiaki of the customary food gathering area/rohe moana.

    (2) The appointments—

    • (a) took effect on 9 October 2014; and

    • (b) expire at the close of 8 October 2019.

7 Reappointments
  • (1) The Minister for Primary Industries has appointed each of the following persons for a further term as a Tangata Tiaki/Kaitiaki of the customary food gathering area/rohe moana:

    • (a) Arapata Hohepa Te Au Reuben:

    • (b) Cherie Williams:

    • (c) Makarini Rupene (Reuben):

    • (d) Te Marino Lenihan:

    • (e) William Edward Dawson.

    (2) The appointments—

    • (a) took effect on 16 November 2014; and

    • (b) expire at the close of 15 November 2019.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on the day after the date of its notification in the Gazette, is made under regulations 9 and 10 of the Fisheries (South Island Customary Fishing) Regulations 1999 (the regulations). It is revoked at the close of 15 November 2019.

The notice relates to a customary food gathering area/rohe moana of which the members of Te Ngāi Tūāhuriri Rūnanga are the tangata whenua. It gives notice of the Minister for Primary Industries’ decision to—

  • cancel the appointments of Ben Te Aika and Justin Fowler as Tangata Tiaki/Kaitiaki of the area/rohe moana; and

  • appoint Tania Waati and Te Maire Tau as Tangata Tiaki/Kaitiaki in their place; and

  • reappoint 5 other persons, each for a further term as a Tangata Tiaki/Kaitiaki of the area/rohe moana.

The Minister made the decisions at the request of Te Ngāi Tūāhuriri Rūnanga, in accordance with regulations 9(5) and 10(1) and (2) of the regulations.

Tangata Tiaki/Kaitiaki may, within their area/rohe moana, authorise individuals to take, for customary food gathering purposes, fisheries resources managed under the Fisheries Act 1996. It is an offence to take those resources for customary food gathering purposes without such authorisation.
