Health Practitioners (Quality Assurance Activity—Pegasus Health (Charitable) Limited) Notice 2015

Pursuant to section 54(3) of the Health Practitioners Competence Assurance Act 2003, the Minister of Health, being satisfied of the matters set out in that subsection, gives the following notice.

1 Title
  • This notice is the Health Practitioners (Quality Assurance Activity—Pegasus Health (Charitable) Limited) Notice 2015.

2 Commencement
  • This notice comes into force on the day after the date of its notification in the Gazette.

3 Revocation of this notice
  • This notice is revoked on 3 February 2020.

4 Declaration of protected quality assurance activity
  • The quality assurance activity described in the Schedule is protected.

Description of quality assurance activity

1 Objective
  • The objective of the activity is to improve the practices or competence of health practitioners by assessing the health services performed by them.

2 Information
  • The activity is based on information derived from health practitioners who perform health services.

3 Description
  • (1) The activity is the quality assurance activities provided or managed for health practitioners by Pegasus Health (Charitable) Limited.

    (2) The activity involves—

    • (a) providing evidence-informed best-practice education; and

    • (b) examining patients’ records; and

    • (c) reviewing—

      • (i) patient management; and

      • (ii) medical management; and

      • (iii) nursing management; and

      • (iv) pharmacist management; and

      • (v) treatment decisions; and

      • (vi) outcomes of treatment; and

      • (vii) internal auditing of procedures; and

      • (viii) patient satisfaction questionnaires; and

    • (d) peer reviewing and clinical auditing; and

    • (e) monitoring, analysing, and peer reviewing—

      • (i) prescribing practices; and

      • (ii) laboratory practices; and

      • (iii) diagnostic practices; and

      • (iv) imaging practices; and

      • (v) referral practices; and

    • (f) identifying and analysing any process or practice that may, but need not, have resulted in an adverse outcome for patients; and

    • (g) making recommendations on how health practitioners can improve their performance so as to—

      • (i) improve the quality of care they provide; and

      • (ii) reduce the incidence of adverse outcomes; and

    • (h) facilitating and monitoring the implementation of recommendations.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice comes into force on the day after the date of its notification in the Gazette. It declares the quality assurance activity described in the Schedule (relating to Pegasus Health (Charitable) Limited) to be protected. A quality assurance activity is an activity that is undertaken to improve the practices or competence of health practitioners by assessing the health services performed by them. The effect of protecting a quality assurance activity is that—

  • any information that becomes known solely as a result of the activity is confidential; and

  • any documents brought into existence solely for the purposes of the activity are confidential; and

  • people who engage in the activity in good faith are immune from civil liability.

The protections given by this notice are subject to statutory exceptions. For example, this notice does not prohibit the disclosure of information that does not identify, either expressly or by implication, a particular individual.

This notice revokes itself on 3 February 2020.
