Fisheries (Notification of Ngā Hapū o Taiamai ki Te Marangi Tangata Kaitiaki) Notice 2015

Pursuant to regulations 9 and 10 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Director-General of the Ministry for Primary Industries, after compliance with the requirements of those provisions, gives the following notice.

Notice

1 Title
  • This notice is the Fisheries (Notification of Ngā Hapū o Taiamai ki Te Marangi Tangata Kaitiaki) Notice 2015.

2 Commencement
  • This notice comes into force on the day after the date of its notification in the Gazette.

3 Interpretation
  • In this notice,—

    area/rohe moana means the customary food gathering area/rohe moana described in clause 2(c) of the Gazette notice

    commencement date means the date on which this notice comes into force

    Gazette notice means the Fisheries (Kaimoana Customary Fishing) Notice (No. 10) 2002 (Gazette 2002, p 4541)

    Tangata Kaitiaki has the meaning given to Tangata Kaitiaki/Tiaki in regulation 2(1) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998.

4 Tangata whenua of area/rohe moana
  • The hapū specified in clause 3 of the Gazette notice are the tangata whenua of the area/rohe moana.

5 Appointment cancelled
  • (1) The Minister for Primary Industries has cancelled the appointment of Puke Taituha as a Tangata Kaitiaki of the area/rohe moana.

    (2) The cancellation takes effect on the commencement date.

6 New appointments
  • (1) The Minister for Primary Industries has appointed the following persons as Tangata Kaitiaki of the area/rohe moana:

    • (a) Piri Taurua:

    • (b) Riki Ashby:

    • (c) Tammy Peri.

    (2) Each of the appointments takes effect on the commencement date.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on the day after the date of its notification in the Gazette, is made under regulations 9 and 10 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998 (the regulations).

This notice relates to the customary food gathering area/rohe moana notified in the Fisheries (Kaimoana Customary Fishing) Notice (No. 10) 2002 (Gazette 2002, p 4541).

This notice confirms the Minister for Primary Industries’ decision to cancel the appointment of Puke Taituha as a Tangata Kaitiaki/Tiaki (Tangata Kaitiaki) of the area/rohe moana. The Minister cancelled this appointment at the request of the tangata whenua of the area/rohe moana, in accordance with regulation 10(1) of the regulations.

This notice also confirms the Minister’s decisions to appoint Piri Taurua, Riki Ashby, and Tammy Peri as Tangata Kaitiaki of the area/rohe moana. The Minister appointed—

  • Riki Ashby as an additional Tangata Kaitiaki, in accordance with regulation 9(1) of the regulations; and

  • Piri Taurua and Tammy Peri to replace Puke Taituha and Keith Ashby as Tangata Kaitiaki, in accordance with regulation 10(2) of the regulations. The cancellation of Keith Ashby’s appointment was confirmed in the Fisheries (Kaimoana Customary Fishing) Notice (No. 3) 2008 (Gazette 2008, p 1523).
