Pursuant to clauses 1, 3, and 12 of Schedule 1 of the Veterans’ Support Act 2014 and section 75C of the War Pensions Act 1954, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

Order

1 Title

This order is the Veterans’ Support (Rates of War Pensions Act 1954 Allowances) Order 2015.

2 Commencement

This order comes into force on 1 April 2015.

3 Increasing rates of certain allowances specified in War Pensions Act 1954

(1)

This clause applies to an allowance described in column 1 of the Schedule and specified in the provision of the War Pensions Act 1954 described in column 2 of the Schedule.

(2)

For the purposes of Schedule 1 of the Veterans’ Support Act 2014, the provisions set out in column 2 of the Schedule of this order in each case are to be treated as amended from the amount specified in column 3 to the amount specified in column 4.

4 Revocation of this order

This order is revoked at the close of 6 December 2015.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 1 April 2015, increases the rates of certain allowances payable under the War Pensions Act 1954.

The War Pensions Act 1954 was repealed on 7 December 2014, but certain provisions of that Act relating to certain allowances and other payments were continued by Schedule 1 of the Veterans’ Support Act 2014 for the benefit of people who were receiving the allowances or other payments immediately before the repeal of the War Pensions Act 1954. The order is made in accordance with section 75C of the War Pensions Act 1954, as continued by Schedule 1 of the Veterans’ Support Act 2014.

The order adjusts the maximum rates of the clothing allowance and the attendant’s allowance (payable under sections 28 and 29 of the War Pensions Act 1954 respectively). The adjustment increases the rates by 0.51%, which reflects the increase in the Consumers Price Index (All Groups) excluding cigarettes and other tobacco products between the December 2013 quarter and the December 2014 quarter.

Expiry, revocation, and validation and confirmation

Under section 75C(3) of the War Pensions Act 1954, this order would expire on the close of the period of 12 months commencing with the date on which it is presented to the House, except so far as it is expressly validated and confirmed by an Act passed before that date.

However, there is no prospect of the order expiring under section 75C(3) because it revokes itself at the close of 6 December 2015. The order revokes itself at that time because, from 7 December 2015, it is redundant. From that date, any person currently receiving the clothing allowance or the attendant’s allowance will receive, under the veterans’ independence programme under subpart 4 of Part 5 of the Veterans’ Support Act 2014, support and services that include allowances that are not less than the allowances payable under this order (see clause 13 of Schedule 1 of the Veterans’ Support Act 2014).
