Fisheries (Notification of Tāngata Tiaki/Kaitiaki for Mātaitai Reserve at Oreti Beach) Notice 2015

Pursuant to regulation 22 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Minister for Primary Industries gives the following notice.

Notice

1 Title

This notice is the Fisheries (Notification of Tāngata Tiaki/Kaitiaki for Mātaitai Reserve at Oreti Beach) Notice 2015.

2 Commencement

This notice comes into force on the day after the date of its notification in the Gazette.

3 Revocation of this notice

This notice is revoked on 8 July 2020.

4 Mātaitai reserve

This notice applies to the mātaitai reserve at Oreti Beach, near Invercargill, that was declared by the Fisheries (Declaration of Oreti Mātaitai Reserve and Appointment of Tāngata Tiaki/Kaitiaki) Notice 2010 (Gazette 2010, p 1849).

5 Reappointments

(1)

The Minister for Primary Industries has appointed Michael Richard Skerrett and Cyril Raymond Gilroy for further terms as Tāngata Tiaki/Kaitiaki for the mātaitai reserve.

(2)

The appointments—

(a)

take effect on 8 July 2015; and

(b)

expire at the end of 7 July 2020.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice is made under the Fisheries (South Island Customary Fishing) Regulations 1999 (the regulations). It comes into force on the day after the date of its notification in the Gazette and revokes itself on 8 July 2020.

This notice relates to the mātaitai reserve at Oreti Beach, near Invercargill.

Notice is given of the reappointment of 2 Tāngata Tiaki/Kaitiaki for the mātaitai reserve. The Minister for Primary Industries reappointed the Tāngata Tiaki/Kaitiaki under regulation 22(3) of the regulations at the request of the Waihopai Rūnaka, which represents the tangata whenua of the area that includes the mātaitai reserve.

A Tangata Tiaki/Kaitiaki for a mātaitai reserve may—

  • ask the Minister to recommend the making of regulations to allow commercial fishing of certain species within the mātaitai reserve:

  • make bylaws restricting or prohibiting the taking of fish, aquatic life, or seaweed from within the mātaitai reserve:

  • authorise the continued taking of fish, aquatic life, or seaweed from within the mātaitai reserve for purposes that sustain the functions of a marae:

  • authorise the relocation of fish, aquatic life, or seaweed within the mātaitai reserve for the purpose of enhancing stocks.
