Fisheries (Notification of Tāngata Tiaki/Kaitiaki for Mātaitai Reserve at Rapaki Bay) Notice 2015

Pursuant to regulation 23 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Minister for Primary Industries gives the following notice.

Notice

1 Title

This notice is the Fisheries (Notification of Tāngata Tiaki/Kaitiaki for Mātaitai Reserve at Rapaki Bay) Notice 2015.

2 Commencement

This notice comes into force on the day after the date of its notification in the Gazette.

3 Revocation of this notice

This notice is revoked on the fifth anniversary of the date of its commencement.

4 Mātaitai reserve

This notice applies to the mātaitai reserve at Rapaki Bay that was declared by the Fisheries (Declaration of Mataitai Reserve) Notice 1998 (Gazette 1998, p 4762).

5 Appointments cancelled

(1)

The Minister for Primary Industries has cancelled the appointments of Tutehounuku (Nuku) Korako and Kahu Phillips as Tāngata Tiaki/Kaitiaki for the mātaitai reserve.

(2)

The cancellations took effect at the end of 28 April 2015.

6 New appointments

(1)

The Minister for Primary Industries has appointed Matea Gillies and Manaia Rehu as Tāngata Tiaki/Kaitiaki for the māitaitai reserve.

(2)

The appointments—

(a)

take effect on the commencement of this notice; and

(b)

expire 5 years after the commencement of this notice.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice is made under the Fisheries (South Island Customary Fishing) Regulations 1999 (the regulations). It comes into force on the day after the date of its notification in the Gazette and revokes itself on the fifth anniversary of the date of its commencement.

This notice relates to the mātaitai reserve at Rapaki Bay.

Notice is given of—

  • the cancellation of the appointment of 2 Tāngata Tiaki/Kaitiaki for the mātaitai reserve:

  • the appointment of 2 replacement Tāngata Tiaki/Kaitiaki for the mātaitai reserve.

The Minister cancelled the appointments under regulation 23(1) of the regulations and appointed the replacement Tāngata Tiaki/Kaitiaki under regulation 23(2) of the regulations. The Minister took these actions at the request of Te Hapū o Ngāti Wheke (also known as the Rapaki Rūnanga), which represents the tangata whenua of the area that includes the mātaitai reserve.

The Tāngata Tiaki/Kaitiaki for the mātaitai reserve may—

  • ask the Minister to recommend the making of regulations to allow commercial fishing of certain species within the mātaitai reserve:

  • make bylaws restricting or prohibiting the taking of fish, aquatic life, or seaweed from within the mātaitai reserve:

  • authorise the continued taking of fish, aquatic life, or seaweed from within the mātaitai reserve for purposes that sustain the functions of a marae:

  • authorise the relocation of fish, aquatic life, or seaweed within the mātaitai reserve for the purpose of enhancing stocks.
