Fisheries (Notification of Tāngata Tiaki/Kaitiaki for Area/Rohe Moana of Te Hapū o Ngāti Wheke) Notice 2015

Pursuant to regulations 9 and 10 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Minister for Primary Industries gives the following notice.

Notice

1 Title

This notice is the Fisheries (Notification of Tāngata Tiaki/Kaitiaki for Area/Rohe Moana of Te Hapū o Ngāti Wheke) Notice 2015.

2 Commencement

This notice comes into force on the day after the date of its notification in the Gazette.

3 Revocation of this notice

This notice is revoked on the fifth anniversary of the date of its commencement.

4 Customary food gathering area/rohe moana

This notice applies to the customary food gathering area/rohe moana defined by clause 2(b) of the Fisheries (South Island Customary Fishing) Notice (No. 2) 2005 (Gazette 2005, p 1105).

5 Appointment cancelled

(1)

The Minister for Primary Industries has cancelled the appointment of Kahu Phillips as a Tangata Tiaki/Kaitiaki for the area/rohe moana.

(2)

The cancellation took effect at the end of 28 April 2015.

6 New appointment

(1)

The Minister for Primary Industries has appointed Tasman Gillies as a Tangata Tiaki/Kaitiaki for the area/rohe moana.

(2)

The appointment—

(a)

takes effect on the commencement of this notice; and

(b)

expires 5 years after the commencement of this notice.

7 Reappointment

(1)

The Minister for Primary Industries has appointed Tutehounuku (Nuku) Korako for a further term as a Tangata Tiaki/Kaitiaki for the area/rohe moana.

(2)

The appointment—

(a)

took effect on 29 April 2015; and

(b)

expires at the end of 28 April 2020.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice is made under the Fisheries (South Island Customary Fishing) Regulations 1999 (the regulations). It comes into force on the day after the date of its notification in the Gazette and revokes itself on the fifth anniversary of the date of its commencement.

This notice relates to a customary food gathering area/rohe moana of the tangata whenua represented by Te Hapū o Ngāti Wheke (also known as the Rapaki Rūnanga).

Notice is given of—

  • the cancellation of an appointment of a Tangata Tiaki/Kaitiaki for the area/rohe moana:

  • the appointment of a replacement Tangata Tiaki/Kaitiaki for the area/rohe moana:

  • the reappointment of a Tangata Tiaki/Kaitiaki for the area/rohe moana.

The Minister for Primary Industries cancelled the appointment under regulation 10(1) of the regulations, appointed the replacement Tangata Tiaki/Kaitiaki under regulation 10(2) of the regulations, and made the reappointment under regulation 9(5) of the regulations. The Minister took these actions at the request of Te Hapū o Ngāti Wheke.

The Tāngata Tiaki/Kaitiaki for a customary food gathering area/rohe moana may authorise any individual to take fish, aquatic life, or seaweed for customary food gathering purposes from within the area/rohe moana.
