Pursuant to section 13 of the New Zealand Flag Referendums Act 2015, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council and on the recommendation of the Minister in accordance with section 13(1) of that Act, makes the following order.

Order

1 Title

This order is the New Zealand Flag Referendums (First Flag Referendum) Amendment Order 2015.

2 Commencement

This order comes into force on 2 October 2015.

3 Principal order

This order amends the New Zealand Flag Referendums (First Flag Referendum) Order 2015 (the principal order).

4 New clause 5 inserted (Alternative flag designs)

After clause 4, insert:

5 Alternative flag designs

(1)

The images of the 5 alternative flag designs that are to appear on the voting paper for the first flag referendum are the images depicted in Part 1 of the Schedule.

(2)

The official descriptions of the 5 alternative flag designs, to be used for the purposes of dictating the relevant parts of the voting paper under section 24(4)(c) of the New Zealand Flag Referendums Act 2015, are set out in Part 2 of the Schedule.

(3)

The technical specifications of the 5 alternative flag designs are set out in Part 3 of the Schedule.

5 New Schedule inserted

After clause 5 (as inserted by this order), insert the Schedule set out in the Schedule of this order.

Part 2 Official descriptions

Silver fern (black and white)

The dominant feature of this flag is a black and white fern frond. The fern frond sweeps diagonally up from the bottom left corner to the top right corner of the flag. The leaves and the stem on the top side of the fern are black on a white background. The leaves and the stem on the bottom side are white on a black background.

Silver fern (red, white, and blue)

The dominant feature of this flag is a white fern frond that sweeps up diagonally from the bottom left corner to the right of the top centre. The left side of the fern is on a red background. To the right of the fern, there are 4 stars, in the formation of the Southern Cross constellation, on a blue background. Each star is red with a white border and has 5 points.

Koru

The right half of this flag is black. At the halfway point of the flag, the black forms a koru on a white background. The black koru spirals down and to the left from the top of the flag.

Silver fern (black, white, and blue)

The dominant feature of this flag is a white fern frond that sweeps up diagonally from the bottom left corner to the right of the top centre. The left side of the fern is on a black background. To the right of the fern, there are 4 stars, in the formation of the Southern Cross constellation, on a blue background. Each star is red with a white border and has 5 points.

Red peak

In the centre of this flag are two thick white diagonal lines. They start in the left and right bottom corners and meet in the centre top, forming an upside-down V shape. The spaces around the shape form triangles. The triangle in the centre of the shape is red, the triangle to the left of the upside-down V shape is black, and the triangle to the right is blue.

Part 3 Technical specifications

Silver fern (black and white)

The flag proportion is 2:3 and the device on the flag is a stylised fern [A].

The fern device has 29 leaflets. The stem originates at the bottom of the hoist and the final leaflet finishes at the top of the fly.

The leaflets and the stem on the top side of the fern device are black on a white background. The leaflets and the stem on the bottom side of the fern device are white on a black background.

The colours are white (Pantone SAFE) in the areas marked “1” and black (Pantone BLACK) in the areas marked “2”.

The Southern Cross device sits within an area measuring five-hundred-and-thirty-three by six-hundred-and-ninety-one eighteen-hundredths of the fly of the flag. Each of the 4 red stars in the Southern Cross device has 5 points and a white border.

The colours are white (Pantone SAFE) in the areas marked “1”, red (Pantone 186C) in the areas marked “2”, and blue (Pantone 280C) in the area marked “3”.

Koru

Red peak

The flag proportion is 1:2 and the device on the flag is a chevron [A].

The chevron device is white and the width of the line is three hundred-and-twenty eighteen-hundredths of the fly of the flag. The left side originates at the bottom left quarter of the fly, the right side originates at the bottom right quarter of the fly, and the centre point is at the centre top of the fly. The background on the bottom side of the chevron device is red. The background on the left side of the chevron device is black. The background on the right side of the chevron device is blue.

The colours are white (Pantone SAFE) in the area marked “1”, black (Pantone BLACK) in the area marked “2”, red (Pantone 186C) in the area marked “3”, and blue (Pantone 280C) in the area marked “4”.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 2 October 2015, amends the New Zealand Flag Referendums (First Flag Referendum) Order 2015 (the principal order). A new clause 5 is inserted into the principal order, prescribing 5 alternative flag designs to appear on the voting paper for the first flag referendum. This order also inserts a schedule into the principal order. The Schedule contains images of the 5 alternative flag designs and, for each of them, prescribes an official description and technical specifications. The official descriptions of the 5 alternative flag designs are to be used for the purposes of dictating the relevant parts of the voting paper to certain electors under section 24(4)(c) of the New Zealand Flag Referendums Act 2015. If electors decide in the second flag referendum that New Zealand should have a new flag, the technical specifications for the new flag that would be inserted in Part 1 of Schedule 1 of the Flags, Emblems, and Names Protection Act 1981 (FENPA) will be the relevant specifications prescribed in Part 3 of the Schedule inserted by this order. The image of the new flag (as depicted in Part 1 of the Schedule inserted by this order) would be inserted in Part 2 of Schedule 1 of FENPA.
