Sale and Supply of Alcohol Amendment Regulations 2015

Pursuant to section 397(1)(f) of the Sale and Supply of Alcohol Act 2012, Her Excellency the Administrator of the Government, acting on the advice and with the consent of the Executive Council, and on the recommendation of the Minister of Justice, makes the following regulations.

Regulations

1 Title

These regulations are the Sale and Supply of Alcohol Amendment Regulations 2015.

2 Commencement

These regulations come into force on 11 December 2015.

3 Principal regulations

These regulations amend the Sale and Supply of Alcohol Regulations 2013 (the principal regulations).

4 Regulation 23 amended (Prescribed qualifications)

In regulation 23(2), replace “Until 1 January 2016, a qualification” with “A qualification”.

5 Regulation 38 amended (Manner of publication of public notice of applications for renewal of licences for premises or conveyance in medium-risk, high-risk, or very high-risk fees category)

In regulation 38(2), replace “35” with “36”.

6 Schedule amended

In the Schedule, form 11, replace “Part 6 of the Act” with “subpart 7 of Part 2 of the Act”.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 11 December 2015, amend the Sale and Supply of Alcohol Regulations 2013 so that there is no longer an expiry date for the validity of the bridging test (which was developed to ensure that applicants for a manager’s certificate who completed their Licence Controller Qualification under the Sale of Liquor Act 1989 could demonstrate knowledge of the Sale and Supply of Alcohol Act 2012) as a prescribed qualification for the purposes of section 218 of the Sale and Supply of Alcohol Act 2012.

These regulations also correct 2 internal cross-references.
