Excluded tunnelling operations

6 Declaration of excluded tunnelling operations

The following classes of operation are declared not to be tunnelling operations for the purposes of clause 4 of Schedule 3 of the Act:

(a)

an operation relating to a tunnel or shaft that is, or is intended to be, of any length where no person ordinarily works underground:

(b)

an operation relating to a tunnel or shaft that is, or is intended to be, 15 metres or less in length where 1 or 2 people ordinarily work underground at any one time in the tunnel or shaft, but only if—

(i)

no explosives are used underground in the tunnel or shaft; and

(ii)

the concentration of methane is unlikely to be more than 0.25% of the general body of air in any working area of the tunnel or shaft.
