These regulations are made under sections 38 and 100 of the Civil Aviation Act 1990 on the advice and with the consent of the Executive Council.

Regulations

1 Title

These regulations are the Civil Aviation Charges Regulations (No 2) 1991 Amendment Regulations 2016.

2 Commencement

These regulations come into force on 1 April 2016.

3 Principal regulations

These regulations amend the Civil Aviation Charges Regulations (No 2) 1991 (the principal regulations).

4 Regulation 20 amended (International passenger security charges)

In regulation 20(1), replace “2017” with “2016” in each place.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 April 2016, amend regulation 20(1) of the Civil Aviation Charges Regulations (No 2) 1991 (the principal regulations). The amendments amend a critical date in regulation 20(1) and decrease the fee payable on or after that new date having the cumulative effect as follows:

  • on or after 1 April 2014, but before 1 April 2016, an international operator must pay to the Civil Aviation Authority $11.98 for each passenger on a flight departing from New Zealand (other than the passengers listed in regulation 20(2)) for the purpose of funding the Aviation Security Service; and

  • on or after 1 April 2016, an international operator must pay to the Civil Aviation Authority $10.58 for each passenger on a flight departing from New Zealand (other than the passengers listed in regulation 20(2)) for the purpose of funding the Aviation Security Service.

The amounts are inclusive of GST (see regulation 33 of the principal regulations).
