Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice amends the Fisheries (Total Allowable Catch, Total Allowable Commercial Catch, and Deemed Value Rates) Notice 2015 (the principal notice). It comes into force on 31 March 2016, and applies on and from the first day of the fishing year starting on 1 April 2016.

The amendments to Schedule 1 of the principal notice vary 1 or more of the following for quota management stocks with certain fishstock codes:

  • total allowable catch (TAC):

  • total allowable commercial catch (TACC):

  • interim deemed value rate (interim DVR):

  • basic annual deemed value rate (basic annual DVR):

  • whether the annual DVR is a different rate for each different level by which a commercial fisher’s reported catch exceeds the fisher’s annual catch entitlement, and the different rates that apply to each level (differential DVR).

The variations are as follows (amounts not mentioned below are unchanged):

Rock lobster—spiny (red)

for CRA4,—

  • TAC is decreased from 662 to 592 greenweight tonnes:

  • TACC is decreased from 467 to 397 greenweight tonnes:

for CRA5, TAC is increased from 467 to 514 greenweight tonnes:

Surf clam—ringed dosinia

for DAN7,—

  • TAC is increased from 15 to 133 greenweight tonnes:

  • TACC is increased from 15 to 120 greenweight tonnes:

Surf clam—large trough shell

for MMI7,—

  • TAC is increased from 61 to 144 greenweight tonnes:

  • TACC is increased from 61 to 131 greenweight tonnes:

Surf clam—deepwater tuatua

for PDO7,—

  • TAC is increased from 52 to 200 greenweight tonnes:

  • TACC is increased from 50 to 184 greenweight tonnes:

  • interim DVR is increased from $0.72/kg to $4.50/kg:

  • basic annual DVR is increased from $1.44/kg to $5.00/kg:

  • differential DVR is changed from special to standard:

Surf clam—triangle shell

for SAE7,—

  • TAC is increased from 112 to 235 greenweight tonnes:

  • TACC is increased from 112 to 217 greenweight tonnes:

  • interim DVR is increased from $0.51/kg to $4.50/kg:

  • basic annual DVR is increased from $1.02/kg to $5.00/kg:

  • differential DVR is changed from special to standard:

Scallop

for SCACS,—

  • TAC is decreased from 131 to 81 meatweight tonnes:

  • TACC is decreased from 100 to 50 meatweight tonnes:

Sea cucumber

for SCC3,—

  • interim DVR is increased from $1.80/kg to $13.50/kg:

  • basic annual DVR is increased from $2.00/kg to $15.00/kg:

  • differential DVR is changed from special to standard.

Schedule 2 of the principal notice sets out the differential DVR for certain quota management stocks. As the differential DVRs for fishstock codes PDO7, SAE7, and SCC3 are changed in Schedule 1 from special to standard, they are now covered by the first item in Schedule 2 (which applies to all fishstock codes with a standard differential DVR) and the separate entries for those codes in Schedule 2 are deleted.

Issued under the authority of the Legislation Act 2012.

Date of notification in Gazette: 17 March 2016.

This notice is administered by the Ministry for Primary Industries.
