Fisheries (Notification of Tangata Tiaki/Kaitiaki for Mātaitai Reserve at Te Kaio Bay) Notice 2016

Pursuant to regulations 22 and 23 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Minister for Primary Industries gives the following notice.

Notice

1 Title

This notice is the Fisheries (Notification of Tangata Tiaki/Kaitiaki for Mātaitai Reserve at Te Kaio Bay) Notice 2016.

2 Commencement

This notice comes into force on the day after the date of its notification in the Gazette.

3 Revocation of this notice

This notice is revoked on 16 December 2020.

4 Mātaitai reserve

This notice applies to the mātaitai reserve at Te Kaio Bay, on Banks Peninsula, that was declared by the Fisheries (Declaration and Notification of Te Kaio Mataitai Reserve and Appointment of Tangata Tiaki/Kaitiaki) Notice 2010 (Gazette 2010, p 3836).

5 Appointment cancelled

(1)

The Minister for Primary Industries has cancelled the appointment of John Boyles as a Tangata Tiaki/Kaitiaki for the mātaitai reserve.

(2)

The cancellation took effect at the end of 27 November 2015.

6 Reappointments

(1)

The Minister for Primary Industries has appointed the following people for a further term of 5 years as Tāngata Tiaki/Kaitiaki for the mātaitai reserve:

The appointments—

(a)

took effect on 16 December 2015; and

(b)

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice is made under the Fisheries (South Island Customary Fishing) Regulations 1999 (the regulations). It comes into force on the day after the date of its notification in the Gazette and revokes itself on 16 December 2020.

This notice relates to the mātaitai reserve at Te Kaio Bay, on Banks Peninsula. The tangata whenua of the area that includes the mātaitai reserve are represented by the Wairewa Rūnanga.

Notice is given of the following changes in the appointment of Tāngata Tiaki/Kaitiaki for the mātaitai reserve:

  • the cancellation of 1 appointment:

  • 6 reappointments, for appointments that expired at the end of 15 December 2015.

The Minister for Primary Industries cancelled the appointment and made the reappointments under regulations 23(1) and 22(3) of the regulations, respectively. The Minister did so at the request of the Wairewa Rūnanga.

The Tāngata Tiaki/Kaitiaki for a mātaitai reserve may—

  • ask the Minister to recommend the making of regulations to allow commercial fishing of certain species within the mātaitai reserve:

  • make bylaws restricting or prohibiting the taking of fish, aquatic life, or seaweed from within the mātaitai reserve:

  • authorise the continued taking of fish, aquatic life, or seaweed from within the mātaitai reserve for purposes that sustain the functions of a marae:

  • authorise the relocation of fish, aquatic life, or seaweed within the mātaitai reserve for the purpose of enhancing stocks.
