Fisheries (Notification of Tuhawaiki Mātaitai Reserve and Tāngata Tiaki/Kaitiaki) Notice 2016

Pursuant to regulation 22 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Director-General of the Ministry for Primary Industries gives the following notice.

1 Title

This notice is the Fisheries (Notification of Tuhawaiki Mātaitai Reserve and Tāngata Tiaki/Kaitiaki) Notice 2016.

2 Commencement

This notice comes into force on the 28th day after the date of its notification in the Gazette (the commencement date).

3 Notification of Tuhawaiki Mātaitai Reserve

(1)

A mātaitai reserve (to be known as Tuhawaiki Mātaitai Reserve) has been declared under regulation 20 of the Fisheries (South Island Customary Fishing) Regulations 1999 over the area enclosed by a line—

(a)

commencing at a point on the mean high-water mark approximately 500 metres north of Scarborough at 44°25.45′S and 171°15.45′E; then

(b)

proceeding in a straight line in an easterly direction for approximately 1.4 kilometres to a point offshore at 44°25.47′S and 171°16.52′E; then

(c)

proceeding in a straight line in a southerly direction for approximately 1.8 kilometres to a point offshore at 44°26.44′S and 171°16.49′E; then

(d)

proceeding in a straight line in a south-westerly direction for approximately 1.9 kilometres to a point offshore at 44°27.38′S and 171°15.86′E; then

(e)

proceeding in a straight line in a westerly direction for approximately 1.0 kilometres to a point on the mean high-water mark opposite the end of Lagoon Drive at 44°27.37′S and 171°15.02′E; then

(f)

proceeding in a generally northerly direction along the mean high-water mark to the point of commencement specified in paragraph (a).

(2)

The declaration of the reserve takes effect on the commencement date.

4 Notification of appointment of Tāngata Tiaki/Kaitiaki

(1)

The Minister for Primary Industries has appointed the following Tāngata Tiaki/Kaitiaki for Tuhawaiki Mātaitai Reserve, each for a term of 5 years:

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice is made under the Fisheries (South Island Customary Fishing) Regulations 1999 (the regulations). It comes into force on the 28th day after the date of its notification in the Gazette.

Notice is given that a mātaitai reserve (to be known as Tuhawaiki Mātaitai Reserve) has been declared under regulation 20 of the regulations (see the Fisheries (Declaration of Tuhawaiki Mātaitai Reserve) Notice 2016). Tuhawaiki Mātaitai Reserve is located in South Island fisheries waters to the south of Timaru. The tangata whenua of the area that includes the reserve are represented by Te Rūnanga o Arowhenua.

Notice is given of the appointment of 16 Tāngata Tiaki/Kaitiaki for the mātaitai reserve. The powers of the Tāngata Tiaki/Kaitiaki are set out in the regulations.
