Land Transport (Offences and Penalties) Amendment Regulations 2016

These regulations are made under section 167 of the Land Transport Act 1998 on the advice and with the consent of the Executive Council.

Regulations

1 Title

These regulations are the Land Transport (Offences and Penalties) Amendment Regulations 2016.

2 Commencement

These regulations come into force on 1 October 2016.

3 Principal regulations

These regulations amend the Land Transport (Offences and Penalties) Regulations 1999 (the principal regulations).

4 Schedule 1 amended

In Schedule 1, under the heading Dangerous Goods 2005 (45001), after the item relating to clause 10.4(b)(iv), insert:

10.4(b)(v)

Driver or operator of road vehicle transporting dangerous goods must ensure traffic signs indicating prohibitions or restrictions on the transport of dangerous goods are complied with

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 October 2016, amend the Land Transport (Offences and Penalties) Regulations 1999 (the principal regulations). The amendment reflects a change made by the Land Transport Rule: Dangerous Goods Amendment 2016 to the rules that apply to drivers and operators of vehicles transporting dangerous goods. A new rule is added that requires drivers and operators to comply with traffic signs indicating prohibitions or restrictions on the transport of dangerous goods. These regulations insert a new item into Schedule 1 of the principal regulations to make it an offence to fail to comply with that requirement.

The Ministry of Transport produced a regulatory impact statement in December 2015 to help inform the decisions taken by the Government relating to the contents of this instrument.
