1 Title

This notice is the Fisheries (Total Allowable Catch, Total Allowable Commercial Catch, and Deemed Value Rates) Amendment Notice (No 2) 2016.

2 Commencement

(1)

This notice comes into force on 1 October 2016.

(2)

However, clause 7 comes into force on 1 February 2017.

3 Application

(1)

This notice applies on and from the first day of the fishing year starting on 1 October 2016.

Amendments for fishstocks whose fishing year starts on 1 October

5 Schedule 1 amended

(1)

In Schedule 1, revoke the items relating to ANG11, ANG12, ANG14, ANG15, and ANG16.

(2)

In Schedule 1, replace each item relating to a fishstock code specified in column 1 of Schedule 1 of this notice with the corresponding item in Schedule 1 of this notice.

(3)

In Schedule 1, before the item relating to LFE17, insert the first 5 items set out in Schedule 2 of this notice.

(4)

In Schedule 1, before the item relating to SFE17, insert the last 5 items set out in Schedule 2 of this notice.

6 Schedule 2 amended

(1)

In Schedule 2, item relating to SWA1, SWA3, SWA4, delete “SWA3,”.

(2)

In Schedule 2, after the item relating to SWA1, SWA4, insert the item set out in Schedule 3 of this notice.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice amends the Fisheries (Total Allowable Catch, Total Allowable Commercial Catch, and Deemed Value Rates) Notice 2015. Almost all of the amendments come into force on 1 October 2016, which is the start of the fishing year for the relevant stocks. The amendments for freshwater eel with fishstock codes ANG13, LFE13, and SFE13 come into force on 1 February 2017, which is the start of the fishing year for those stocks.

The amendments set or vary 1 or more of the following values or matters for quota management stocks with certain fishstock codes:

  • the total allowable catch (TAC):

  • the total allowable commercial catch (TACC):

  • the interim deemed value rate (interim DVR):

  • the basic annual deemed value rate (basic annual DVR):

  • whether the annual DVR is a different rate for each different level by which a commercial fisher’s reported catch exceeds the fisher’s ACE, and the different rates that apply to each level (differential DVR).

Stocks of freshwater eel in the South Island are divided into long-finned and short-finned stocks by the Fisheries (Alteration of Quota Management Areas—Freshwater Eel) Order 2016. This notice revokes the values or matters for the original stocks (ANG) and sets them for the new stocks (LFE and SFE).

The values or matters set or varied by this notice are as follows (anything not mentioned below is unchanged):

Barracouta

  • for BAR5, the TAC is increased from 7 475 to 8 370 greenweight tonnes and the TACC is increased from 7 470 to 8 200 greenweight tonnes:

Blue cod

  • for BCO3, the interim DVR is increased from $2.50/kg to $3.38/kg:

Bluenose

  • for BNS1, the TAC is reduced from 425 to 351 greenweight tonnes and the TACC is reduced from 400 to 327 greenweight tonnes:

  • for BNS2, the TAC is reduced from 474 to 392 greenweight tonnes and the TACC is reduced from 438 to 358 greenweight tonnes:

  • for BNS3, the TAC is reduced from 194 to 162 greenweight tonnes and the TACC is reduced from 171 to 140 greenweight tonnes:

  • for BNS7, the TAC is reduced from 69 to 57 greenweight tonnes and the TACC is reduced from 62 to 51 greenweight tonnes:

  • for BNS8, the TAC is reduced from 33 to 28 greenweight tonnes and the TACC is reduced from 29 to 24 greenweight tonnes:

Frostfish

  • for FRO4, the interim DVR is increased from $0.12/kg to $0.22/kg:

Green-lipped mussel

  • for GLM9, the interim DVR is increased from $3.00/kg to $5.40/kg:

John dory

  • for JDO7, the TAC is increased from 161 to 206 greenweight tonnes and the TACC is increased from 150 to 190 greenweight tonnes:

Jack mackerel

  • for JMA3, the TAC is set at 9 000 greenweight tonnes and the TACC is reduced from 18 000 to 8 780 greenweight tonnes:

  • for JMA7, the interim DVR is increased from $0.08/kg to $0.14/kg:

Kahawai

  • for KAH8, the interim DVR is increased from $0.31/kg to $0.55/kg:

Long-finned freshwater eel

  • for each of LFE11, LFE12, LFE13, and LFE14, the TAC is set at 3 greenweight tonnes, the TACC is set at 1 greenweight tonne, the interim DVR is set at $9.00/kg, the basic annual DVR is set at $10.00/kg, and the differential DVR is set to standard:

  • for LFE15, the TAC is set at 66.54 greenweight tonnes, the TACC is set at 52 greenweight tonnes, the interim DVR is set at $9.00/kg, the basic annual DVR is set at $10.00/kg, and the differential DVR is set to standard:

  • for RBY3, the TAC is increased from 3 to 32 greenweight tonnes, the TACC is increased from 3 to 30 greenweight tonnes, the interim DVR is increased from $0.10/kg to $0.25/kg, the basic annual DVR is increased from $0.19/kg to $0.28/kg, and the differential DVR is changed from none to standard:

  • for RBY4, the interim DVR is increased from $0.21/kg to $0.25/kg and the basic annual DVR is reduced from $0.42/kg to $0.28/kg:

  • for RIB7, the interim DVR is increased from $0.40/kg to $0.72/kg:

Scampi

  • for SCI2, the TAC is increased from 140 to 161 greenweight tonnes and the TACC is increased from 133 to 153 greenweight tonnes:

Short-finned freshwater eel

  • for SFE11, the TAC is set at 24.87 greenweight tonnes, the TACC is set at 19 greenweight tonnes, the interim DVR is set at $7.20/kg, the basic annual DVR is set at $8.00/kg, and the differential DVR is set to standard:

  • for SFE12, the TAC is set at 26.1 greenweight tonnes, the TACC is set at 20 greenweight tonnes, the interim DVR is set at $7.20/kg, the basic annual DVR is set at $8.00/kg, and the differential DVR is set to standard:
