Fisheries (Notification of Tāngata Tiaki/Kaitiaki for Mātaitai Reserve at Mahitahi/Bruce Bay) Notice 2016

Pursuant to regulations 22 and 23 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Minister for Primary Industries gives the following notice.

Notice

1 Title

This notice is the Fisheries (Notification of Tāngata Tiaki/Kaitiaki for Mātaitai Reserve at Mahitahi/Bruce Bay) Notice 2016.

2 Commencement

This notice comes into force on the day after the date of its notification in the Gazette.

3 Revocation of this notice

This notice is revoked at the end of 27 August 2021.

4 Mātaitai reserve

This notice applies to the mātaitai reserve at Mahitahi/Bruce Bay, on the west coast of the South Island, that was declared by the Fisheries (Declaration and Notification of Mahitahi/Bruce Bay Mātaitai Reserve and Appointment of Tangata Tiaki/Kaitiaki) Notice 2011 (Gazette 2011, p 3819).

5 Appointment cancelled

(1)

The Minister for Primary Industries has cancelled the appointment of Mata Holliday as a Tangata Tiaki/Kaitiaki for the mātaitai reserve.

(2)

The cancellation took effect at the end of 27 August 2016.

6 New appointment

(1)

The Minister for Primary Industries has appointed Jeffrey Mahuika as a Tangata Tiaki/Kaitiaki for the māitaitai reserve.

(2)

The appointment—

(a)

took effect on 28 August 2016; and

(b)

expires at the end of 27 August 2021.

7 Reappointments

(1)

The Minister for Primary Industries has appointed the following people for a further term as Tāngata Tiaki/Kaitiaki for the mātaitai reserve:

The appointments—

(a)

took effect on 28 August 2016; and

(b)

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice is made under the Fisheries (South Island Customary Fishing) Regulations 1999 (the regulations). It comes into force on the day after the date of its notification in the Gazette and revokes itself at the end of 27 August 2021.

The notice relates to the mātaitai reserve at Mahitahi/Bruce Bay, on the west coast of the South Island. The tangata whenua of the area that includes the mātaitai reserve are represented by Te Rūnanga o Makaawhio.

Notice is given of—

  • the cancellation of the appointment of 1 Tangata Tiaki/Kaitiaki for the mātaitai reserve; and

  • the replacement appointment of 1 Tangata Tiaki/Kaitiaki for the mātaitai reserve; and

  • the reappointment of 6 Tāngata Tiaki/Kaitiaki for the mātaitai reserve.

The Minister for Primary Industries made the cancellation and appointments at the request of Te Rūnanga o Makaawhio.

The powers of Tāngata Tiaki/Kaitiaki are set out in the regulations.
