Real Estate Agents Authority (Fees and Levies) Notice 2016

Pursuant to sections 20, 21, and 22 of the Real Estate Agents Act 2008, the Real Estate Agents Authority gives the following notice.

Notice

1 Title

This notice is the Real Estate Agents Authority (Fees and Levies) Notice 2016.

2 Commencement

This notice comes into force on 1 February 2017.

3 Fees and levies

(1)

The Real Estate Agents Authority sets the fees and levies, payable to the Registrar or the Authority, specified in the Schedule.

(2)

The fees and levies in the Schedule apply on and from 1 February 2017.

(3)

However, the manual processing fee applies on and from 1 February 2018.

4 Manual processing fee

The manual processing fee in the Schedule applies to the following applications if not made electronically on the Authority’s digital portal:

(a)

an application for a new licence:

(b)

an application for annual renewal of a licence:

(c)

an application for voluntary suspension of a licence:

(d)

an application for annual renewal of voluntary suspension of a licence.

5 Refunds

(1)

Fees are not refundable.

(2)

Levies are not refundable except on the death of a licensee.

6 Tax

Fees and levies are exclusive of goods and services tax.

7 Revocations

The following notices are revoked:

Real Estate Agents Authority (Fees and Levies) Notice 2009 (SR 2009/343), to the extent that it is not revoked impliedly by the notice referred to in paragraph (a).

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice updates the fees and levies payable to the Real Estate Agents Authority, starting on 1 February 2017. The notice also introduces a new manual processing fee, starting on 1 February 2018.

This notice is a legislative instrument and a disallowable instrument for the purposes of the Legislation Act 2012 and must be presented to the House of Representatives under section 41 of that Act.
