This order is made under section 55 of the Maori Trust Boards Act 1955 on the advice and with the consent of the Executive Council.

Order

1 Title

This order is the Aorangi Māori Trust Board Order 2017.

2 Commencement

This order comes into force on the day after the date of its notification in the Gazette.

3 Interpretation

In this order,—

Board means the Aorangi Māori Trust Board.

4 Background

(1)

The term of office of the previous members of the Board expired on 1 March 2016.

(2)

The Board held an election of new members, which was completed in May 2016.

(3)

However, the election was irregular because of the failure to comply with the following procedural requirements for conducting an election under the Act:

(a)

the requirement under section 46 to give notice calling for nominations for election no later than 4 months before the term of office of the previous members expires (nominations were instead called for on 9 April 2016):

(b)

the requirement under section 46 to give notice in writing addressed to all Maori Committees, Maori Executive Committees, and District Maori Councils constituted under the Maori Community Development Act 1962 in a certain district or districts:

(c)

the requirements under sections 46 and 47 to give notice that the latest date by which nominations are to be lodged is the date that is 3 months before the term of office of the previous members expires (the date was instead notified as 9 May 2016):

(d)

the requirement under section 47 to lodge nominations with the Secretary of the Board not later than 3 months before the term of office of the previous members expires (the nominations were instead lodged by 9 May 2016):

(e)

the requirement under section 49 to forward to the chief executive of Te Puni Kōkiri the names of the persons elected no later than 20 days before the term of office of the previous members expires (the names were instead forwarded on 29 June 2016).

5 Validation and appointment

Despite the irregularities specified in clause 4(3),—

(a)

the 2016 election of members to the Board is, and always has been, valid; and

(b)

the persons elected, as named in the Schedule, are appointed as members of the Board to represent the beneficiaries for a term of 3 years starting on the commencement of this order.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order comes into force on the day after the date of its notification in the Gazette.

The order validates the election of members to the Aorangi Māori Trust Board. The members were elected to represent the beneficiaries of the Board. The election was subject to the irregularities specified in clause 4(3) of the order.

The order appoints the elected persons as members of the Board to represent the beneficiaries.

The members are appointed for a term of 3 years starting on the commencement of this order.
